Hello,
I am from Turkey and I did my application to Damascus in December 2009.
Now they call me to an interview in 26 July 2010 to Damascus. I have a fiancé and I did not mention about her in my demand. Because I thought to sponsor her after I got the permanent residence. But I noticed that sponsorship is a costly and hard way to bring her, so I decided to marry her. So what do i need to do to add her to my file. Should I marry her before the interview? What happens if I marry her after I get my CSQ? Will my CSQ be cancelled and I will need to apply for it again if I marry her? Please help me, If it will be a problem to marry after obtaining the CSQ, I will marry her in this month. I have very limited time. They say I need to inform them about my marriage immediately but I am not sure whether they cancel my interview if I do that. What will they want me to send more about my future wife?
Thanks for your quick answers...

i think you should inform them before interview, so that they can process your application acordingly. hopefully they will not delay/cancel your interview.

seniors may comment better.

Burak - you have to decide if you want to go with your fiance now or she can stay behind for several months and come later. Also Canada recognize 'common law partnership' you can add your fiance to your application without getting married if you can prove that you have lived together for at least 1 year.
To add her to your application you would need to complete all the forms for her as a dependant, show proof of your relationship and updated proof of settlement funds.
I don't know your personal situation but if I were you I would do it now. This may or may not delay your overall timeline.

We havent lived together :(
But I can add her after I marry her, only thing I worry about is whether my CSQ is cancelled after I declared that I got married. Isnt there a way to add her as my wife between obtained CSQ and PR visa. I dont care the delays, I only want to go to Canada with her. She doesnt want to wait without me :(

You can add her at anytime before the visa stamping but the later you do it the bigger the potential of delaying the process.

No problem for delays but what will happen to my CSQ? Do I have to retake it if I get married? Can they cancel my CSQ?

i dont think so that there is any possibility of cancellation of CSQ, or you have to re-take it. you wil be the principal applicant, and CSQ is awarded mainly on your qualification/training.

thats my opinion, others may comment better.

Hello Burak,

Don't panic. It's not that complicated. The immigration process is really so reasonable.
If you get married (congrats), you will have just to inform them in Damascus visa office, to include your wife to your application.

This is only to measure her qualification in addition to yours before issueing the CSQ for you.

This would be better before your interview..as they may ask you (as the main applicant) & her (as your wife & co-joint applicant) to be present in the interview.

It's not complicated since you're taking the right steps.

I wish you best of luck & happy life ever after :)

Thank you very much Iceberg, you are so kind.
We will get married after I get the CSQ, but before the visa. So they will call her to interview again? or they will cancel my CSQ?
Thanks...

Burak,

As you know the QSW is a 2-step process
1st. to apply/get the CSQ
2nd. to apply/get the PR visa issued by the Federal Gov. based on the Selection Certificate.

By receiving the CSQ, you'll the CSQ holder..who're eligible to apply for the PR visa..you're the one who have been selected.

The Federal Gov. cannot issue a PR visa to your wife based on the selection certificate she doesn't get.

I hope you got my point.

Canadian Immigration Minister Jason Kenney announced this week Canada's plans to target marriage fraud among immigrants.

According to newly released documents, Canada's border agency has opened more than three dozen criminal investigations related to marriage fraud in the last few years.

"The most effective tool is to stop fraudulent marriages from being approved in the first place because they are so hard to deal with once the person is admitted into Canada. We will continue to be very vigilant. It's difficult, we want to let the legitimate married couples in but keep the fake ones out and that's what our officers are trained to do," said Kenney.

According to Kenney some overseas spouses have married Canadians simply to gain immigration benefits to Canada. Once in Canada some foreign spouses leave their Canadian spouse. There have even been cases of mistreatment of Canadian spouses by overseas spouses.

According to the government, new laws to curb immigration through fraudulent marriages will go into effect next year. The new regulation will impose a two year period of conditional residency on foreign sponsored spouse. Spouses who have emigrated to Canada will not be able to themselves sponsor an overseas spouse for five years.

"If you come in as a sponsored spouse and become a permanent resident and then divorce your Canadian husband or wife, you will not be able to turn around and sponsor someone from overseas," Kenney said.

It is believed that a large number of these 'fake' spousal sponsorship visa applications come from China and India. Recently, a large number of applications from China were rejected.

"Canadians were being paid up to $60,000 by criminal organizations, to sponsor Chinese citizens they had never met and we started interviewing these applicants and we found out they knew nothing about the spouse and they had no consistent story or proof of relationship," said Kenney.

While it is common in South Asian countries for marriages to be arranged by families and a couple may not know very much about each other until after the marriage, Kenney noted that officials are specially trained to make an assessment of such situations.

"We know that in many cultures and religions it's conventional to have an arranged marriage, and our officers approve bona fide arranged marriages all the time. But if it looks like the marriage was not arranged for family, for the purpose of living together, then we will reject the application. So the test is whether the marriage is legitimate or whether it is just done for immigration purposes," he said.
