Hello there

Here is my situation

We become married 2009 and immigrant 2012. After becoming PR we are not living together but hoping situation will be resolved, but its not the case.

To complete the divorce process this year January I divorced her in Bangladesh where the marriage conducted. ( Both of us Bangladeshi citizen ). Now I want to marry in Bangladesh and sponsor my wife.

What is the actual procedure?

In my understanding

First I have to notify the CIC the divorce has been conducted according to Bangladeshi law.
Then do I need to get permission if I marry In Bangladesh?

What is the actual process to bring the new person after marriage?

Your comments will be appreciated.

Regards

I'm not sure what permission you are asking about. You don't need to notify CIC of the divorce.

Once you have all the required documents, you submit the whole sponsorship and application to CIC Mississauga. As a PR, you must be living in Canada throughout the process.

How did you get your own PR? If you were sponsored by your spouse under family class, then you would need to wait 5 years after landing before you can sponsor any new spouse. If both of you immigrated through some other immigration stream, then you can sponsor new spouse immediately.

Also since you are a PR, you must be residing in Canada to submit the PR application and also stay in Canada during the processing. Your new spouse must apply for and be approved for a TRV if she wants to stay in Canada during this processing time.

Thanks for your reply

I was a FSW and principal applicant. Since we both became PR in 2012 as she was my wife. Now I divorced her in Bangladesh. Someone told me that I need to get a marriage license from ontario.

I am planning to get marry in Bangladesh. My question is do I need a license to get marry in Bangladesh or what is the actual procedure to sponsor new wife?

In that case there is no waiting period, you can sponsor her immediately after getting married.

For requirements to get married in Bangladesh you need to check with their government, that has nothing to do with Canada or Ontario or CIC. You only need an Ontario marriage license if you will get married in Ontario. You do not need to register foreign marriages in Canada either. As long as you were divorced properly from first spouse and new marriage is legal in district you are doing the marriage, then that is acceptable to Canada.

For applying her PR you'll need copy of divorce papers from previous spouse, and marriage certificate for current spouse (all translated to english).
