I NEED GUIDANCE . I HAVE 2 YOUNGER TWIN BROTHERS , BOTH ARE INTERESTED FOR PR IMMIGRATION .NOW THE PROBLEM BOTH ARE FACING REGARDING THEIR MARITAL STATUS ARE AS BELOW


ONE BROTHER IS UNDERGOING MARITAL DISCORD & WANTS TO FILE A DIVORCE CASE . WILL THERE BE ANY PROBLEM IN HIS PR CASE IF DIVORCE CASE WILL BE CONTINUING IN THE INDIAN COURT. IF YES , THEN HOW TO DEAL WITH IT .

MY OTHER BROTHER IS NOT HAVING THAT MUCH OF MONEY SO THAT HE CAN APPLY FOR HIS WIFE IMMIGRATION , SO CAN HE COME ALONE NOW ?

Hi Shalini,

Your brother (1st) needs to have his divorce papers in hand to be in clear. But if its not possible (if the CAP for his profession is closing in) then go ahead and apply to be considered in CAP and attach a cover letter describing his current status with his Divorce proceedings. He may be required to fill in additional or re- fill his forms at a later stage of processing.

For your 2nd brother, unfortunately, I will have to second Shibuya.

There is no way of applying without Proof of funds for both of them to apply together. But if his spouse is not accompanying him and he has funds for himself then by all means he can apply. He will also not be able to claim points for his spouse. He can later sponsor his spouse after he gets his PR...only the processing times for Sponsoring spouse is couple of years ( I do not know exactly how many years).
