Hi guys, I would really appreciate if someone could clarify on an issue I am facing.

I want to make my Express Entry profile, but am a bit unclear on what to put in my legal marital status.

I am in the middle of a mutual divorce, which should be finalised by October end. However, as of now, what should I put in my application? Should I show as married or divorced or is there some other category which represents me better?

If I show as married, would my points be affected?

For example, even in the Eligibility test, it asks 'How many family members do you have?', and asks us to include spouse even if they are not accompanying us to Canada.

My divorce cannot be affected now, and if it was left to me, I would prefer to already put Divorced, but I don't know if they might see it as misrepresentation. I would really appreciate if someone could throw some light on this issue.

Hello all

I dont know why I am not able to start a new topic. Hence, I am posting my query here.

I have got my PR last month and I am going to get married in January 2016.
How will my spouse get PR?
How much time will it take?
What is the best process we should follow to get her PR asap?

Please guide. I am new to all this.

There are 2 ways you can do this. Your spouse can apply for PR under EE or you can sponsor them under Family Class after getting married.

Tough to predict which is the fastest route. EE would typically take less than 1 year if your spouse gets an ITA based on their points. Family class typically takes between 12-24 months depending on your particular situation.

Read more on the CIC site about both programs, scan the threads on this forum and speak with a lawyer as well.

Or is it possible to get Work Permit for her so that she can accompany me and continue her career there.

Waiting for 12-24 months will hamper her career if she accompany me on visitor visa too.

Please guide. In dilemma.

There is no way to get PR at such short notice. They can apply for a work permit but it is better to go through family class eventually leading to PR.

Hi Asivad, thanks for your reply in another topic. I have taken note that I will have to show my current status and as you suggest, will show as Separated if there is such an option.
I would like one point addressed. Would my points be affected?

I haven't tried that option so I can't comment with full knowledge. It depends on how the system treats a 'separated' applicant - I'm guessing it will treat you as Married. Which means you will lose 40 points for the spouse angle. If that's the case, apply only after you can legally and rightfully claim to be divorced.

Would you recommend making the profile now and updating it to divorced when the legal formalities are over or would you suggest I wait until November 1 to make the profile?
I am getting around 460 points as a single candidate.

Use the CRS tool to see how many points you get by claiming to be Separated'. If you get treated as a single candidate, go for it now and update your marital status later in the process.

There's a CRS tool? Please provide the link, if possible.
I know there's a grid, but I thought we had to calculate manually from on there.

Apparently, Divorced/Separated are treated similarly, and I am getting 464 points.
