Hi everyone!

I live in the Philippines and I am in a same sex relationship. My partner applied in MPNP however, he declared in his application form that he is single because there is no such thing as common law partnership in the Philippines.

When he arrived in Manitoba, we tried applying for common law partner sponsorship but we were denied because IRCC informed us that I was not declared a common law partner and was not examined at the time of my partner’s application for MPNP.

Questions:
1. Since I placed Common Law as my marital status in my personal details when I applied for common law sponsorship (however denied), will I still be using common law as my marital status if I apply for other streams, such as Atlantic Immigration Pilot?
2. Is it okay if I rather indicate that I am single in future application forms for different programs since I was denied of the common law application?
3. How will IRCC record my marital status in their database? Will they record that My marital status is common law even though I got denied? I want to know because there is a statement in the application forms that the details that I placed will be recorded and will be used as basis for future applications.

Hi, it's important to note that IRCC did not deny your common law status. They denied you because in order for your partner to be eligible to sponsor you, they needed to declare you at their time at landing, and they did not. It has nothing to do with whether or not your common law status was legitimate. If you have lived together consecutively for over 12 months, you should be declaring yourself as common law.

Ff up question pls. If I use Single as marital status in my future application in Canada for different program, will it possibly affect the decision of IRCC?
 
IRCC keeps your old applications on file and will reference them on future applications. It will be noted that you applied common law previously and are now applying single. That would be misrepresentation and can get you barred from Canada from 5 years. Never lie to IRCC!
