Marital Status Change After Filling Application

Hello,


Could someone with prior experience please advise on the below.

I applied for my PR under CEC from outside Canada in July 2012 and it is still under processing. Since applying, I got married towards the end of the 2012. What is the process to update Immigration Canada about the same? I have already emailed a local Canada Visa office advising the same and also wrote an email to the CIO Sydney office. I haven't received a reply from both offices.

Also is it mandatory that I apply for a PR for my wife(as a dependent) right away or can I wait till after I get my application approved.

You don't have to apply for your wife's PR . Your wife is automatically included as your dependent in the application.
Even if she never intends to travel to Canada, still she will be taken in consideration for PR, only because she is your wife.
I am sorry I dont know the procedure to update your application.
But by law, you have to let them know about your marriage.

No this is wrong .... You have to inform visa office about your change in marital status and its optional to add your spouse in the application. Until you mention it in the application and pay fees, your spouse will not be added in the process.

Once inform via email, VO then will advice you to follow some steps that you need to follow (will take few weeks to get reply). Whatever, you choose you have to fill up few forms and documents (See minta7 comments in http://www.canadavisa.com/canada-immigration-discussion-board/updated-topics/-t120338.0.html;topicseen). While filling up those forms specially IMM008, you have option to apply for your spouse or not. Also, if you do not intend to apply for your spouse, you don,t have to pay application fee (550$).

Also there are 10s of thread in this forum about adding spouse in the middle of PR process, do some research.

Please note that it is easy to add your spouse now than sponsoring him/her after you received your PR.

Below is the sample letter from the VO once you inform them about change in your marital status. I was forwarded this email by one of the forum member upon my request.

We acknowledge receipt of your correspondence informing us of a change in your family composition due to marriage.
In order to continue processing your application, additional documents are required. (Always include your file number on all correspondence)
(A) If your spouse is a citizen or permanent resident of Canada, he/she must submit the following documents:


• 1. Proof of citizenship or permanent residence
• 2. A copy of your marriage certificate or proof of your common-law relationship
No processing fee is required in this case.
(B) If your spouse is not a citizen or permanent resident of Canada, he/she must submit the following documents whether he/she will accompany you to Canada or not:
• Copy of the bio-data pages of current valid passport (Must include passport number and validity date)
• Completed application forms (enclosed):
• IMM 0008 Generic – All pages must be completed and page 5 signed by the principal applicant; pages 3-5 must show details of the newly added spouse, common-law or conjugal partner and all dependent children of principal applicant or spouse/partner.
o IMM 5669 Schedule A - to be completed by spouse, common-law or conjugal partner and all dependant children over age 18.
• IMM 5406 - to be completed by spouse, common-law or conjugal partner
• IMM 5409 - Statutory Declaration of Common-law Union if applicable
• Four passport-sized photographs
• Copy of your marriage certificate if applicable
• Copy of birth certificate (legible)
• Police certificates from any country where he/she has resided for six months or more since age 18 (Refer to the CIC website http://www.cic.gc.ca/english/information/security/police-cert/index.asp
• Copy of divorce certificates/from any previous marriage(s)
o (If minor children are involved, custody documents must be included)

You must send these documents in hard copy (not via email) to the following address:

This payment must be made to the Detroit visa office in a format acceptable to that office. Once Detroit has received the processing fee, your spouse's application status will be changed to an accompanying dependant.
Please also note that before a Permanent Resident Visa can be issued, every applicant and his/her spouse, common-law or conjugal partner who meets the admission requirements for permanent residence in Canada is required to pay a Right of Permanent Resident Fee (RPRF) in the amount of $490 Canadian (or current USD equivalent). The visa office in Buffalo will request this fee at the appropriate stage in the processing of your application.

Best of luck ... also you can search in the forum about the experience of others. As I mentioned, there are 10s of thread about similar issue in the forum.

And please do not forget to share yours as it will be very helpful to the further applicants, including me :).

Email your visa office, CPP-O, and they will guide you, as in the above email. It will take couple of weeks to get reply from them (as I was told).

I have emailed them related to the addition of spouse to the application and I received the same mail from them.
So I still might need to check with them about the fee payment as well I think...

Hello everyone,

Can anyone tell me from their experience how long it takes for CPP-O to reply you when you notify them by email about the Change in Marital Status?
I emailed them 2 weeks ago and still no word from them!
My husband has to return back to the home country within next month or so and I would like to know all the documents needed for him to add on the file before he leaves the country

The documents required for adding spouse the application are listed in the email that has been posted by ConfuseApplicant. And from what has been mentioned, it looks like Raichu also got the same email from CPP-O.

Hello, Im a provincial nominee applicant, but I have also added my common law partner to my application. I got an email from CPP, and my only question is does anybody knows what is the application kit they are referring too in the document checklist? I am confused about it and haven't found anything on CIC website to clarify, appreciate any support from someone who has done it. Also on the email says I can send all documents to them by email, has anyone done it that way? thanks again. Following is the original email from ottawa.

copy of birth certificate of your spouse
copy of your spouse’s valid passport

an original or a notarized “no” criminal activity certificate for your spouse
a completed application kit with all the requirements
updated IMM0008 Generic and updated IMM5406 “Additional Family Information” form for yourself
copy of marriage certificate
a “Certificat de Sélection du Québec” for your spouse ( in his or her name), if you wish your spouse to immigrate to the province of Québec with you at this time (http://www.micc.gouv.qc.ca/fr/index.asp) [Only for Quebec Skilled Worker Class Applications]
Copies of the original documents with original certified translations into English or French are required. All documents must be sent by mail, fax (see fax number and address below) or email.

Hi,

As per the mail from CPP-O, I'm planning to add my spouse in the application; however he is not currently in Canada and may travel to Canada in some time through TRV. Can I update the application with his current address(back home)? If I do that, then Do I need to update the application again with his latest address in Canada once he is here?
Any one has any ideas? Plz help!!!
