Hi Heartbreakid,

Have you considered living with your partner for a year and establishing a common-law relationship? The fact that your partner is still married is not a problem to entering into a new common-law relationship as long as he and his wife are separated. I suggest this because you are waiting for the annulment to come through anyway and the CIC looks very closely at conjugal relationships.

"In general, people who have made the level of commitment expected in a conjugal relationship
would normally marry or live together. If a foreign national could have married their Canadian
sponsor or lived with them, and chose not to do so, then it is questionable whether they have the
significant degree of commitment characteristic of a conjugal relationship.
The conjugal-partner applicant should explain why they have not been able to live continuously
with their sponsor for at least one year. In most cases, there will be an immigration impediment to
continuous cohabitation (e.g., inability to obtain long-stay visas for one another's country). Noncohabitation
for purely personal or economic reasons (i.e., did not want to give up a job or studies)
does not normally qualify as a sufficient impediment, but should be assessed on a case-by-case
basis. Applicants should be able to provide evidence that they have seriously considered living
together as common-law partners. For example, they might have explored options for living
together in one another's country, such as work or study permits, how their occupational skills and
qualifications would be recognized in their partner's country, visitor visas, long-term visitor status,
etc."
 
hi jarry, thanks for the reply! its greatly appreciated! although its the first time ive heard this, that we have the option to cohabit for a year and apply as common law, this idea is like a light on the end of the tunnel, but i would like to ask other senior here in the forum if this is possible?

if it is true, i will start paying my credit cards and maybe take this option :-)

Hi everybody. I'm the sponsor for same sex M-M conjugal visa. The visa has been received and my partners flight to Canada booked for this March 2013.

At long last, the wait is over and my partner will be joining me in Canada! :)

So don't be discouraged hearing 1% of conjugal visa's get approved. Ours is another successful example. Even our interview was waived.

im doing imm 00008 now
im confused with question 13 asking my present status? we are going to apply under conjugal and i cant find it on the options? or should i choose common law? or is it asking of my previous marriage? *confused* help pls asap

and another in the later part its asking if i have a national document? is this the birth certificate? prc id? or nbi clearance? ty in advance!

I'm not totally familiar with your situation, but I assume you are not married. Here are the answers:

Marital Status: Single
National Identity Document: No

I was advised that for the purpose of your application, your sponsor is your partner - so don't put married, because your first wife isn't included in the application is she ::). I wrote "Common Law" because there was no option for conjugal, then attached a note to explain.

The question on the form asks your marital status. Since this is a conjugal application, they obviously know you are NOT married or commonlaw to your Canadian sponsor. So I disagree with Steph's advice. Technically you are still married, so that should be your response. The question stands alone... regardless of your current relationship.
 
Heartbreakkid, I would suggest that you select the martial status category "legally separated" which simply means you are still married but no longer living with your spouse.

youre right steph, but i have already answered common law since uts asking for my present status and after that question it actually aaked for my previous marriage and for how long it lasts?
