Hi guys,

After waiting for 37 months after applying for citizenship and no updates I am considering going for filing a mandamus. I would appreciate any advice on filing, referrals to lawyer, lawyer costs etc. Thanks!

Mandamus will likely cost several grand and there is no guarantee of success. What else have you done? Requested your GCMS notes? Have you reached out to your MP's office? Sent IRCC a letter, etc.? A mandamus action will have a greater likelihood of success if you have done these things first.

I have requested GCMS notes and sent IRCC emails for request to advise on the progress of the application but only got generic replies that it is undergoing administrative processing. Sent the MP an email requesting his assistance but did not get any reply. I do not know what else to do this seems so unfair. There appears to be no easy path to recourse or any operational standards at IRCC.

Do the GCMS notes give any idea what is going on?

No updates since June last year and the case status says on hold. I don't know why it would be on hold.

You can always send them an "urgent" Case Specific Enquiry "requesting the application status because you are considering a mandamus action". It might cause them to pay attention to you?

Hassan it will cost between 6 to 10 thousands, if you can afford you should drag them to court.

Most of CIC officers are not capable instead to solve minor issue with little follow up they keep innocent peoples waiting for years.

This rather long post from another forum is quite useful. Worth the time. It is somebody who did this mandamus and succeeded in getting PR

Any updates on this hasan?

Time is money, for a person like myself(currently unemployed, finding it impossible to get a job) if paying a few thousand dollars can save me a few month of waiting, and hence a few month of getting a job in Canada sooner, I would go for it.

1.Just withdraw and apply new one as Mandamanus will cost you dearly and can take same amount of time and no Gaurentee u will succeed.

2.Whatever decision contact your local MP, Immigration Minister and Social and faith based groups from your area and community. (First get respectable Social Faith group endorsement 2 or more letters indicating how you have been affected, and you are intergrated into Canadian society and feeling bad your situation is limbo with CIC to Minister and local MP)

BUT IF I WAS YOU After 18 months I would have withdrawn and reapply for another luck.

Bad idea
1- you lose express entry points as you get older, hence you may not have the same score you did 18 months ago
2- The score/draw that got you in might not come back, or at least might not come back soon enough, and you get older waiting for that...

I would never jeopardize my ITA just to try my luck, it's not a game. Much better to try and file a lawsuit even if it costs some money. It costs a lot if it reaches court, but often, cic finishes the application when they receive the lawsuit and it doesn't need to go through...

Not sure if you’re still around. I’m interested to know what happened to your case.

Did you go the mandamus route?
