hi every body,
I and my wife and son go to canada as a PR in 2010 and now my wife and son got canadian citizen but my PR card is expired when i was outside canada and also does not meet residancy obligation(stayed only 380 days out of five years) and my wife is still in canada .MY question is regarding ,how much time will be taken for clearance in spouse immigration (PR) if my wife sponsor me again under spousal immigration category.i belongs to india.Is there chance of rejection of my application( Second time application for PR).
There is another way to enter in canada on the basis of present PR status but PR card expired.

pls reply as soon possible with yours valuable experiences.

The last time I checked processing times for India on trackitt.com it said somewhere between 200 and 300 days for most cases of spousal sponsorship. I don't know if it would be any faster just because you had PR before.

You will not be rejected based on medicals if you are being sponsored and not because you did not meet the RO. Most spousal case refusals happen because immigration is not sure of the relationship. Now obviously you have been married to your wife for many years, however, they might question the nature of your relationship if you choose to live in different countries. It is your job to convince them in your application that your relationship is genuine and still ongoing.

Until you get your sponsorship, you can apply for a multiple entry visit visa. If you are planning on continuing to live outside Canada, you might not want to apply for sponsorship at this point because you would just end up in the same situation again. You can apply later when you are ready to move.

You also have to officially lose your old PR status before you can either be sponsored for PR again or apply for a visit visa. You can do that by renouncing it.

You could have flown to Canada while your PRC was still valid. Had it been the case CBSA would have let you in and you could have stayed in Canada for 730 days without living to maintain you PR status and apply for a new PRC after that. But you are past that point.

Now your best bet would be to follow Leon's advice and give up your PR status voluntarily. Once it's done, apply for a visitor visa if you want to visit your family once in a while and continue to live in India as your country of permanent residence. Have your wife apply for sponsorship ONLY when you decided to move to Canada for good.

how we can justify that our relationship is genuine(Means what types of documents / proofs rrequired).
Leon we are thinking that we will apply a new PR application because it will take hardly one year and if we use citizen spouse accompanying outside canada and then apply for PRTD so we have to stay straight two years outside canada.Now after five month. i am totally free from my home country.Is i am thinking right direction or there is risk to apply and percent chances of refusal if apply new application for PR ( spouse citizen canada )

You can show proof of visits to each other, photos of you together on your holidays, communication when you are not together, phone bills, emails etc. Your old PR as I have said is pretty much useless because you don't meet the RO, don't have H&C grounds for not meeting it and you are outside Canada and because you have your wife to sponsor you, there is really no risk. I think it is very unlikely that you would get refused.
