Maintaining PR while overseas

Hi All,

I became a PR in Feb 2013 and since then have stayed physically in Canada for 3 months only. While in Canada I interacted with few companies and finally signed a master franchise agreement for UAE with a well established Canadian company. I am now in UAE running that business.
My question is will I as a Permanent resident representing the business interests of a Canadian company qualify to maintain PR status when it comes up for renewal in 2018.

Since it sounds like all you are operating a franchise or your own business marketing a Canadian product, it won't qualify. It has to be a wholly owned Canadian subsidiary and you need to be on a contract with specific term of assignment.

I agree with the comments above.

Based on the dates you provided, you don't meet the residency requirement at this time for retaining your PR status. If keeping your PR status is in fact a priority, you should make plans to move back to Canada as soon as you can.

In general the exemption to the RO for employment requires you to be hired for a role in Canada first, and then assigned on a temporary basis to a position overseas by your company, with the expectation you will return back to Canada when the temporary assignment is finished.

Since this doesn't apply to you at all, I would expect you are now in violation of the RO so will possibly face being reported and process started to revoke your PR status next time you attempt to return to Canada.
