I came to Canada with my wife and I am the main applicant. After graduation, I received my PGWP and my wife got hers as my depandant. Unfortunately, things between us didn't go well and we are currently living apart. If I file for divorce, will she immediately lose her PGWP (wich is still valid for another couple of years)?

No. They are not dependent. She would not be able to renew of course. Her's is not a PGWP, but a dependant Open Work Permit.

1. IS SHE HAVING AN OPEN WORK PERMIT OR PGWP? DOUBLE CONFIRM THAT CUZ THEY ARE DISTINCT IN LEGAL TERMS.

2. I ASSUME SHE IS HAVING AN OPEN, BECAUSE YOU MENTIONED THAT SHE IS YOUR DEPENDENT, AND U DID NOT MENTION SHE GRADUATED FROM A DLI LISTED CANADIAN INSTITUTION

3. IF SO, LEGALLY, NO, SHE DOES NOT QUALIFIED FOR THE OPEN PERMIT CONDITIONS THAT USED TO APPLY, WHICH IS DETERMINED BY SPOUSAL RELATIONS.

4. HOWEVER, CBSA WON'T "TAKE AWAY" HER PERMIT AND ASK HER TO LEAVE, YOUR CASE IS TOO MINOR FOR THAT. BUT KEEP IN MIND THAT HER PERMIT IS NOT VALID, EVEN THOUGH SHE HAS IT IN HER PASSPORT.

5. CBSA DOES NOT KNOW THAT YOU TWO ARE DIVORCED, AND IF YOU TWO NEVER FILE ANYTHING TO IRCC IN THE FUTURE, THEY WILL NEVER KNOW.

Turn the CAPS off.

Her work permit remains completely valid. Don't post incorrect information.
