Looking for input on various concerns - employment / supporting docs

Hi! My wife and I got married last December after dating for three years. I'm 21 (Canadian Citizen), she's 25 (USA Citizen). We have a few concerns I'm hoping to get some feedback on. For context, we have been spending most of our time together over the past two years, but just as visitors to each other's country. We're applying under the Family Class.


Concern 1

Employment wise, I haven't been employed in nearly 4 years. I hope this doesn't look too bad (since I'm 21 and still living with family), but it has been causing me a lot of worry nonetheless. I'm hoping if I provide proof of substantial enough savings, and back it up with proof that we're living cost-free with family, that it will not be an issue? Would it be a good idea for me to get a letter from my family vouching to support both of us if need be? I have been looking for work as well, but am not sure if we should wait until I start working to submit the application.

A related concern is that my wife was homeschooled, and hasn't had a formal job at any time. I hope this doesn't look suspicious...


Concern 2

On form IMM 5533, there is a section that says I need one document from three of the following sets of options:

  • Joint ownership of residential property or joint residential leases or joint rental agreements listing both the sponsor and the principal applicant; (Minimum 1 document).
  • Proof of joint utilities accounts (electricity, gas, telephone); (Minimum 1 document).
  • Important documents for you and your sponsor showing the same address, such as copies of Government issued identification documents: driver's licenses, insurance policies, etc.
  • Important documents for you or your sponsor showing that you are recognized as each other's spouse (such as employment or insurance benefits). (Minimum 1 document).
  • Documentary evidence of financial support between your sponsor and yourself.
  • Other proof that your relationship is recognized by your friends and/or family (e.g. Letters, social media information showing a public relationship, etc.)

Unfortunately for us, anything from those first 3 sets is likely impossible as we don't formally live together. I pay for her cell phone bill, but it is a single account under my name. The 4th option I'm unsure of anything that could fit it, since we're neither employed nor pay for insurance. The 5th option is difficult because when I buy things for her it doesn't tend to be documented. The only thing I can possibly think of is just a couple PayPal gifts back and forth from eachother. The 6th option is a piece of cake.

What do you suggest we do to try to fill this requirement? It seems heavily skewed toward people applying under the Spouse or Common-Law Partner in Canada Class, and I'm totally stumped as to what people in a situation like ours can do.


Concern 3

And finally, less of a major concern. As for photos (up to 20) that we can provide to support our relationship, we have a ton of wedding photos, but most of our other photos together have been few (neither of us selfie much!) and not very significant (we don't travel or do many events). Should I be worried about the photos being from mundane situations?

As for text communication (up to 10 pages), nearly all of our communication while apart is through instant messaging. We have years of all sorts of conversations from almost every day saved, what kind of thing do you recommend including?

1. it is not required for the sponsor to be employed or have an income. there are many sponsors who successfully sponsor their spouses without employment or income. you will want to show in your application how you plan to support yourself and your spouse after approval without needing welfare assistance. this can be done in many ways: showing the type of job you/your spouse intend to apply for, industries you want to work in, letters from family members in canada who are willing to help you out while your get on your feet, etc. not being employed or an income is not a dealbreaker. they just want to make sure you are prepared to support your spouse.

2. if you don't have the required info, then supply what you can and write a letter of explanation as to why the other stuff isn't available. don't just assume you can't get this stuff done. it may be possible to add each other to utility bills or beneficiaries. you won't know until you actually try. they want to see that you have tried, not that you just assume it's not possible. in your letter of explanation you can discuss your attempts at getting these things done.

3. it's not an issue at all if the pictures aren't anything special. that will actually help you prove your relationship validity, because they want to see you in your real element, not just posing at special occasions. for text logs, pick samples from each month or so that shows every day communication and any messaging about your plans to settle in canada.

Brilliant, this makes a lot of sense. I always forget how helpful a letter of explanation with supporting evidence could be.
I neglected to mention that neither of us actually pay any utilities at all (which is understandable), but I will try to add her as a beneficiary if I can! Then hopefully we will be able to satisfy the requirements.

it's also recommended to change your status with CRA to married, and submit proof of that.

I don't think I've ever communicated with the CRA directly. Should I try to do it through my bank, or call them?

it's not done through the bank as they don't have anything to do with taxes. it can be done online on the CRA website. i'm not sure if you'd be able to do it over the phone, but it's worth a shot.

I applied before the app changed in December 2016 but I think you are still supposed to provide your most recent year tax return notice of assessment. If you haven't done your taxes due to not having an income, you should probably still go and file, you can change your status then.

Oh, I didn't know you could it was possible to file without having adequate income. In that case I might as well, this time. Thanks!
