Hi i am hoping just to get some clarification on the whole ARC process

Little background: I married by husband while he was still a refugee claimant however in january 2015 he was asked to leave the country in 3 weeks. I had just found out a few days earlier i was expecting our first child so.it was very hard seeing him go. But he left of the day he was given and his ticket was also paid. In july 2015 i sent out the spousal sponsorship application...took a while since i waited to get everything from medicals to fbi clearence etc. since i thought everything needed to be send together.

MY QUESTION
1.since he left when he was asked is its still just a departure order or a deportation since they paid for his ticket?

2.Does he have to apply for a ARC?

3.or will they just process sponsorship and then just request the
removal fee of 1500$???

Anyone had similar experience....does it make the process longer if he does apply for arc? I am just really missing my husband and it been so difficult him not meeting our daugther yet he sees her eveyday on skype but its just really not the same.

1. It's a deportation.
2. Yes - he will need an ARC.
3. Yes - they will process your spousal sponsorship application and then request the $400 fee + cost of the airline ticket once they reach that stage of processing.

Yes - the overall process is longer if an ARC is required.

Thank you for you reply its just not clear since on the CIC website it says with you leave within the 30 days you do not need a arc

That rule applies to departure orders (not deportation orders). If Canada paid for his flight home, that's a deportation order. Can you confirm that he did not pay for his ticket home? What exactly did he receive? What did the letter say?

They did play for his ticket...he had an appointment after his refugee claim was refused....and was given a letter which said he had to present himself at the airport on a specific date or buy a ticket before that date a present himself at the same office to give them hos flight info.... the letter simply says its a removal order and the date and time he needed to be at the airport...the person did tell.him that following his spousal sponsorship he would have to pay the 1500$ for his ticket but there was no mention of an arc

Its a removal order, but because he is a refugee claimant he will need and arc and pay a $400 fee + $1500 ticket.

He must have immigration warrant againts him. He is getting married to Canadian citizen in USA. Should she submit spousal sponsorship and ARC together? Or she should submit sponsorship and wait for instructions to follow regarding ARC?

She should submit the spousal sponsorship application and then wait for the ARC to be requested.
