After waiting for over 3 months and 1 week,my employer was informed that LMO was rejected.Now he waits for official letter with an explanation why.


I'm very disappointed about that :-[

sorry to hear that Endura..... do you know the reason for rejection?

If the employer don't prove, that he a need a foreign worker to fulfill the job. And he should show that he/she can't find a local people(ie Canadian or PR) then only they will approve it. It's a pretty slow and frustrating process.
 
I've got answer about rejected LMO


The company is required to advertise locally for the employee position a total of 3 consecutive months.


I've never heard about three months of advertising,i thought 4 weeks nation wide are required by law.

NOC number is 7611,and the company has advert on jobbank.gc.ca for over 4 months now :'(
 
4 weeks advertising has been changed to 3 Months recently.

I have been searching for official proof of this requirement and haven't found it yet. I thought it was four weeks in the previous three months. Hmmmm. Let's keep looking.
 
Again I have found reference to four weeks consecutive advertising but the following is also included:

Employers must continue to advertise the available position and actively seek qualified Canadians and permanent residents until the date they receive notification that a labour market opinion has been issued

The LMO application was rejected for the second time. :(

We found that regardless of the shortage of pipe layers in this country, because pipe laying in not a recognized “trade” here, they will not allow us to import anyone here to fill these positions.

Tough time man.
The new rule clearly say that employer should not stop advertising till a LMO is issued. Lots of changes that keeps employers and employees on edge. :o

I don't get it. What is your employer doing wrong? It seems to me like he did everything right.
 
Sorry I posted for the previous messages. Any reason or explanation why they rejected it again?
 
And something else . We have already apply since November 2013 , with the new rules about lmo service canada includes also our applications ?
