LMO refused because ESDC still using NOC 2006

Hi,

I just applied for an LMO last month for job title Pharmacy Technician (NOC 3219) according to NOC 2011. Today I received bad news that it is refused because they are still using NOC 2006 version in which Pharmacy Technician becomes Pharmacy Assistant (NOC 3314), and thus is not qualified for Higher-skilled stream.

My work permit expire Aug, 2014. Please help :( :(

Sorry to hear about your difficulties. But -

a) You cannot apply for an LMO for yourself. Your prospective employer has to apply to be approved to hire you.

b) The rest of it does not make any sense, ESDC would not be using NOC 2006. Pharmacy technician (NOC 3219 - B) and Pharmacy Assistant (NOC 3414 - C) are different occupations with different job duties and responsibilities. If the position was classified as NOC 3414 (Skill Level C), that was because the job duties / wages did not meet the requirements for NOC 3219. Regardless of whether your employer used NOC 2006 or 2011, they have to meet the requirements...

1/ Sorry i was not clear on my part. Yes, my employer applied for the LMO.

2/ The lady who process the LMO contacted us, saying they are still using the NOC 2006. YES THEY ARE STILL USING THE NOC 2006. I know it doesnt make any sense but she insisted that we applied for the stream of lower skill. The job duties and qualification is exactly the same as what the NOC 2011 said. And even if it's not correct, my employer is willing to make it so for me. But because they are using the NOC 2006, all effort is wasted.

Geez, 1 step forward, 2 steps back... Looks like you're right, they are indeed still using 2006 themselves (or have gone back to it, I could swear they switched at one point), even though they're soliciting updates for the 2016 version,

Alas, CIC is using NOC 2011 - any chance you would qualify under a PNP program, and could obtain a work permit that way?

As of right now I am not qualified for pnp or any other pr streams. I'm thinking about re-applying for a study permit to keep my status going while my boss apply for he LMO under lower skill class. Good idea or no ? But thanks for your info though :)

What would you do with a study permit? Are you going to further your education while waiting for a valid working status, i.e PR or work permit?

If you are not gonna study, it would be better to take visitor visa. You are not allowed to work with either study permit or visitor visa thou...

With a study permit i can work off campus and prolong my legal status here. Even though it is against my intention, it is still a temporary plan while waiting for a new LMO.
