Hi,


My LMO application is refused and PGWP is expiring next month, Service Canada called my employer and he did't satisfy them that my Job responsibilities are under NOC O A OR B.

I'm running out of time.

How can I secure my status

Any suggestions ?

Apply for a BOWP, if you meet the requirements.

I'm on the same boat, LMO denied but my WP has also expired.
From what I learnt now, you can extend your stay as a visitor.
If you have already applied CEC (and received your AOR), you can apply for BOWP.

Correct.

If you have already applied CEC (and received your AOR), you can apply for BOWP.

Correct, if you still hold a valid work permit which is due to expire within 4 months.

because my work permit is expiring next month and I'm completing one year of my work experiance next month as well.

So confused!!!

Yes, you can apply for CEC on a visitor visa, or even outside Canada.

You have the exact situation as me, 1 year work permit and only get enough working experience till the end. But at that time, my LMO results was not yet known, so I submitted a WP application and became under implied status. LMO was denied after that.

Now your LMO results is denied before PGWP expires, if your employer is not going to re-submit LMO application, the only way for you to stay is change status to visitor. You can't apply for a BOWP since your WP is expired before receiving AOR. But being a visitor is not for long run either, you (and me as well) will probably have to return to home country and wait for the CEC process.

I can feel you pain, but that's life.

There's a problem with the bigger picture - if your LMO was refused because your duties don't match a skilled NOC, then it is extremely unlikely that you qualify under CEC...

Rather than wasting money, energy, hope, and several months waiting for a doomed CEC application as a visitor, you need a strategy that will ensure that you qualify.

For example, you don't say what province you are in, but some PNP programs accept lower-skilled experience.

Or, rather than changing to visitor, perhaps returning to study for a higher degree is an option.

if your employer is willing to resubmit LMO ,submit a new application with new job title and responsibilities .U have chances to change job position in the same company.Put a new job title which comes under NOC 0 A B and medium wages (very important).
i dnt knw which noc you applied for...u must check http://www5.hrsdc.gc.ca/ for responsibilities make modification dnt just copy paste...

when i applied i put a cover letter too...stating clearly about my skill and experience and i am the best fit for the position...
convince your employer tell him your situation...dnt waste time talk to your employer

If they aren't the same, there's a problem... and yes, CIC will know what NOC is on the LMO because it goes on your work permit.

A friend of mine who is from IEC and got his LMO denied too. He applied CEC under another NOC because of the median wage.
(The NOC for LMO is more professional and thus higher wage while his wage is actually the NOC for CEC)
But for his case, the NOC for LMO is just an intended job, isn't it?
Should I advise him to withdraw and re-apply with the same NOC?

u mentioned your LMO rejected .So why u want to match your CEC NOC with LMO NOC.
Are under PGWP?
If you were working before under closed work permit(LMO) and want to apply CEC,then ofcourse both NOC should be the same

I'm really not understanding this. Your NOC is what best describes your actual occupation/job duties, and if the NOC is not classified as skilled, then wage is completely irrelevant.

There is only one NOC that best matches your job duties, if you need help figuring out what your NOC is, and many people do, then post your job duties. Wage is not a requirement of CEC, but an NOC that corresponds with your actual work IS a requirement.

But if you're playing games with job duties and NOCs, then, good luck, the VOs are pretty good at spotting cheats.
