Hi,
I have selected for cook position for a new business which is going to open in a couple of month my employer told me that he is going to apply for my LMIA soon , in this situation my question is processing time of my LMIA application will be vary from a already running business And a new business? I m in a confused situation right now because of my LMIA will be approved for New business? Or it will take lot of time to get approval? Please friends any body have any idea about my situation? I will be thankful to any suggestions! Thanks in advance!

Generally it should already be an established business. However your employer can certainly try. Your employer will need to start by advertising the job to prove no Canadian could be found for the role. This advertisement must meet the LMIA minimum criteria and must be done for at least a month before the LMIA application is submitted. The processsing time for the LMIA application itself will likely be at least 4 months. So you have a while you wait yet before you will know if they have been successful and you can apply for a work permit.

Yes - I would plan on waiting four months.

I thought a business had to be established for a year before they could start hiring TFW? Or am I thinking of something else.
I’m from India and I really don’t know about all those details and I’m in a still confused situation!

Just make sure you aren't paying any money in exchange for the job / LMIA. If they ask you for any money, it's a scam.

Thanks for that info,I didn’t paid any money for them,actually they are reputed chain of restaurants , but I have got selected for their upcoming new outlet which is going to be opening soon , That’s my case!

Doesn't matter if it's a reputed chain of restaurants - you need to be sure you are dealing with someone who actually represents that restaurant rather than a scammer. It's very easy for scammers to pretend they represent a real restaurant.

Are they offering you free accommodations, food or transportation?

No, in offer letter they didn’t mentioned about free food or accommodations !!

OK - well that's a good sign. Your best option would be to post the job offer here removing any personal details if you have any concerns about whether it's real. We see tons of fake job offers on this forum and can advise you if anything about the letter indicates that it is a scam.
