Dear Folks,

I'm currently working US company having Canada office. I'm getting an offer from another Canadian employer with positive LMIA. Meanwhile my current company is also willing to sponsor ICT work permit.

Could anyone comment on the success rate and speed of work permit processing between LMIA based vs LMIA Exempt work permit via ICT? Which one is more practical ?

Are you in a management role?
 
Yes both are senior roles and yes i qualify for ICT since I spent more than a year in my current company.
 
Is this a senior role? Do you qualify for ICT? That would be the first question.

It doesn't have to be a senior or management role. It can be a specialized knowledge role.

There's really no way to comment on success rates of one vs. the other. Way too many variables. Work permit processing speed is slow right now for both categories. I don't think there's an advantage on either end there right now.

Both are closed work permits that only permit you to work for that specific employer in Canada. So no difference there.

If you plan to apply for PR, then there's an advantage to the LMIA work permit since you can claim 50 points for having a job offer immediately vs. waiting until you've worked for the employer for a year in Canada.
 
@scylla - Thanks for the catch. Yes my role is actually a specialized knowledge role only. I misread @canuck78's question. So rephrase, my NOC is 2173 (type A). It is not NOC 00

    • are currently working for an employer specified on the work permit - which will be true since ICT is a close work permit...
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer - which is also true since this is a precondition for ICT
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa - which is also true as per the offer letter...

See my post above. You can claim the 50 points for the ICT but only after working for your employer for a full year in Canada.

For the rule you've quoted, the one year of full-time work experience must be in Canada. Work experience outside of Canada is not counted under the above rule. So this is why you have to work in Canada for your employer for a full year under the ICT before you can claim the 50 points.
