I just got this job recently, my employer is ready to get me LMIA, the problem with that I only have 2 months work permit left. I was looking to apply for extension after getting my AOR but unfortunately my cec file was received by cic after the cap got filled. How would I extend my work permit with LMIA? :(

IF you have LMIA; you won't need work permit.

If you obtained an LMIA then you would get a new work permit, however I doubt you'd get an LMIA within 2 months since the employer has to advertise the role for 4 weeks before they can even submit the paperwork and then it's a 3-4 month wait after that point for the LMIA, unless your employer applies for one of the free 10-day LMIAs to support your EE profile with 600 points, however you wouldn't be able to use this one for a Temporary Work Permit and you would have to get an ITA, submit PR application and receive an AOR before you could get a BOWP, which I don't think would happen within 2 months.

doubleym @ Thanks for your reply. I have been working with this employer for a month or so. What is "free 10-day LMIAs" and what does my employer have to do to get it for me?

If you get your employer on the LMIA ASAP then you can apply for a work permit 2 days before it expires stating that you have applied for LMIA. This will give you 'implied status' for 8 weeks until there is a decision on your LMIA. It might give you just enough time to pull it off.
If you miss the deadline then worst case is you stop work until the LMIA comes through and then either apply for work permit online or flag pole to the border.

That's great to know, such good information. I wasn't sure that LMIA continues processing while ones pgwp is expired. I might as well can apply for a visitor visa till my LMIA processes?

Well if you can extend your current work permit then by applying for the LMIA will give you a two month window after your work permit has expired which will allow you to continue working.
I just finished a 9 week implied status where my permit expired and i was able to continue working until 2 weeks ago when my status expired due to LMIA not complete yet.

It bought me 9 extra weeks of work.

Now, while i await the LMIA to be finalized, i am out of status and have 90 days to apply for restoration. IF i get LMIA within this period i can apply for work permit AND restoration at the same time. Hold off applying for visitor as its harder to go from visitor to worker.

Same boat for me. I applied for CEC Nov 12 and with the cap been reached apparently then i must go EE too.

But with LMIA then thats 600+ points! 1200 is the max points.

So LMIA = PR
