Hello Everyone!

I'm currently under a work permit under Restaurant Manager; my work permit is due to expire on September 4th and my employer is still awaiting for the LMIA to be issued. I also submitted my PR paperwork to CIC a month ago and awaiting for the file number.

I understand that I have 90 days 'grace period' to renew my status; but if that does not happen... what options do I have while I wait for the LMIA or the file number from my PR(so I can apply for OWP)

I heard that I can switch my status to Visitor to extend the 90 days even further? any help is greatly appreciated!

Thank You! :)

Well, you are now within 2 weeks of the expiration of your current work permit, so you are allowed to apply for to extend your work permit with the "LMIA pending." You need to provide some proof that your employer has applied for the LMIA, date applied, etc.
http://www.cic.gc.ca/english/helpcentre/answer.asp?q=701&t=17

If you apply for a new work permit BEFORE the old one expires, you will be on "implied status" and can continue to work under the same conditions as your previous work permit, until you receive a response from CIC.

But if you don't apply until after your work permit expires, then - no implied status, and you have to quit working until you receive a new work permit. You then have a 3-month grace period to apply to restore AND extend your work permit (costs more), but you cannot work until you get the new work permit.

Thank you so much for giving me this information!

what proof does CIC need? will a letter from the employer stating that the LMIA application has been supplied be sufficient? or do they need the actual LMIA application?

Thank You

My new Employer offered me 0632 NOC store Manager. They submitted my LMiA application August 26. Just sharing guys. Hope it will be approved soon. I am here in edmonton.

@ Kj1225,

It is good to add a copy of the LMIA along with your work permit application. That is what my employer has done. A letter would not be a enough proof that you have applied for LMIA.

Which province and what NOC?

Thanks

I tried to find out what was going on with mine as we have not heard anything and it was completed and posted early November. I was told that the information is confidential and only the employer can be informed.
