Hi,

I have Post graduate work permiit. My company is willing to file LMO for me and I am running out of status in Dec 2014. Is it true that if you have PGWP, than your company don't need to file LMIA, they can file LMO directly.

Thanks

You don't need an LMIA while your PGWP is valid. However if your PGWP is expiring in December 2014, then your employer must definitely obtain an approved LMIA in order for you to then obtain a closed work permit and continue working.

Also - you seem to be confusing the LMO and LMIA terms. An LMO and LMIA are the same thing. LMO is the old name and LMIA is the new name. If you want to continue working after your PGWP has expired, then your employer needs to obtain an LMIA and then you need to apply for a work permit.

My company is willing to file LMO by at least Nov 16, 2014 and my work permit is getting expired by second week of Dec 2014. So it is said after 14 days of your LMO application, you can apply for bridge Work permit which will be for 6 months (within that time frame will have LMO reply).

I'm not sure you understand the rules of bridging open work permits.

Bridging Open Work Permits are only available to those who have applied for PR through a program such as CEC or PNP and have AOR. Have you applied for PR already? Do you have AOR?

If all you have is a PGWP and you haven't applied for PR, then you don't qualify for a BOWP.

Hi,

Once you have the file number for your LMIA (LMO) application send a paper application for your work permit. Make sure that you send the work permit application before the expiry date of your current PGWP.

You will be on implied status till a decision is made on your work permit application allowing you to legally work & stay in Canada.

The current processing time for a paper application is 68 days. That will hopefully buy you the time needed for the LMIA to be approved.

Best of luck.

Hi, Even PGWP holder for LMIA application, Company has to show :

1) Advertisement of particular position for 4 weeks
2) All details like "Number of interview they took for this position"

Some people say PGWP holder are exempt from going all this, they simply have to follow old LMO process and some say rule after 6 july 2014 is change even PGWP holder have to follow all LMIA procedure.
