Here are some details:

My Status: PGWP expiring on August 16,2014( Toronto)

I studied a 1 year post secondary certificate and have more than 7 years experience in similar field back in India

Job Noc 5241 : Currently on a fulltime job with more than a median pay, about 25$ an hour. What do you think as per chances with the new LMIA rules to extend my work permit. My company is ready to do whatever is needed to as they need me for the project for at least an year more. I have been working for this company since January 2014.

As per the below link, it mentions that my company does not need to advertise before applying LMIA( or LMO earlier) as it is a specialized skill.

I believe you're referring to the digital media advertising exemption? ESDC's website does say that no advertising is required for NOC 5241 and 2171, but also that the position must "require highly-specialized skills and/or unique artistic talents in order to successfully complete projects." Highly specialized and unique skills are normally accompanied by a higher than average wage. My understanding is that a wage of $25/hour is probably not sufficient. Your employer should call Service Canada to find out more about what wage would be expected in order for advertising to be waived.

Hello prashanthbv!

Do you have any news about your LMIA process? I'm interested to know if you have any chance to stay. I'm a graphic designer too, currently with a working holiday visa and I'm still looking for a job, because I just arrived in Canada; but I want to be prepared if I will find some company that will decide to require an LMIO for me. As a noc5241 the company shouldn't need any advertise but what about the wages? Let me know as soon as possible if you have official news. Thank you so much.

You have to read the entire description, which says:

Description: The position is for one of the following occupations:

Software Engineers and Designers (NOC 2173)
Graphic Designers and Illustrators (NOC 5241)
The advertising variation is limited to Digital Entertainment Software Engineer (NOC 2173) and Digital Artist (NOC 5241) positions within the video gaming and digital animation/visual effects industries. These positions require highly-specialized skills and/or unique artistic talents in order to successfully complete projects.

Variation: No advertising or recruitment is required.

Applicability: British Columbia and Ontario


All the requirements have to be met in order for the variation to apply. Not all NOC 5241 jobs will qualify.

So if I'm a graphic designer I won't have any chance, only digital artist. Ok! maybe I can start to take a look for some flights tickets to go home! :'(
I actually think it's pretty impossible to have a positive LMO!

if you are a graphic designer in british columbia or ontario yes you have the chance and your employer is exempted from the advertising requirement.

Unfortunately I don't believe you would fit in this variation, because the website does say: "The advertising variation is limited to Digital Entertainment Software Engineer (NOC 2173) and Digital Artist (NOC 5241) positions within the video gaming and digital animation/visual effects industries."

Yes as the description says my job falls under the NOC 5241 and the company is a Digital animation/video gaming company. So i am guess this position is exempted from the advertising requirements. And my wage is above the median wage for High skilled workers in Ontario. So do i stand a good chance?

Hi,

I'm a Full time employee at SHAW in Calgary. I works as an intermediate quality assurance analyst my NOC is 2171.
My PGWP expires Aug 2016. And My express entry score is 404 and the CRS invitaion score is at 753. Don't think it could ever come down there without an LMIA and a nominee.
Applied for a nominee (AINP) in March this year. Thinking of doing an LMIA and I'm highly doubtful organizations like Shaw would do an LMIA for a foreign worker. What other options do I have? this process has gotten so riddiculous.
Would an LMIA be my only resort now?
