Hope below clarifies.CAPRasiprer said:Thanks Guys,
Seems this change is for applicants who are already in Canada. My employer is starting this process (Intercompany WP) from next week. Thus not sure, if this change will help me?
1. 200 points if the offer is in an occupation contained in a Major Group 00 of the National Occupational Classification, or 50 points for a job offer in any other skilled position.CAPRasiprer said:Thanks thinkshady...however still confused....
1. I'm currently in US on L1 visa (Senior Manager - IT firm). Same employer (working for 5 yrs- different locations) is filling for WP under ICT and was planned to do WP for PR so that I get 600 points and get PR. Now post Nov 19th rule change - will I get 200 points while filing for WP under ICT, no need to do LMIA for WP for PR?
2. Or this rule / change is only for those who already in Canada under WP?
No more 600 points. If you get LMIA done then a total of 50 points will be awarded to candidates with a valid job offer in a National Occupational Classification (NOC) 0, A or B occupation, while a total of 200 points will be awarded to candidates with a valid job offer in a NOC 00 occupation.CAPRasiprer said:Thanks again...
so old rule of having 600 points if employer file LMIA for WP for PR is still there for outside candidates? Or only new rule applied...?
No you did not get it. Since you are not in Canada and do not have a year experience you cannot claim LMIA exempt ICT specific 50 points. If your employer is ready to file LMIA (which is different from LMIA exempt) then you might be able to claim 50 or 200 points based on your NOC after LMIA is approved.CAPRasiprer said:Thanks.. this is very helpful...
so what is the process now, this is my understanding:
1. File for WP under ICT
2. Once I get it..I need to use that WP to put in my express pool
3. That will enable me to get 200 points or I need to wait for 1 yr to get those points?
4. Once I get points wait for call from CIC?
Suggest?
1. You can show experiences with different NOC's without loosing pointsCAPRasiprer said:Thanks a lot.
Some unrelated questions on next steps, I should follow:
1. I was in Canada (WP) till Sep 2014 and went back to India. I filed under Express Pool in Dec 2014, however have low points 380+ (age factor reducing my points).
2. my lawyer said, that I'm no longer eligible under CEC, so from this year, she has put me under FSW within Express Pool, for which I need to have 67 points. Right now it' matching as my exp# gets max points.
3. I recently placed as Sr. Manager.
4. My employer agrees to have WP under ICT, however I'm pushing to file with LMIA, which will help me secure 50 points asap. However those 50 will not be sufficient as my total point post getting those 50 will be ~430 (under Express), which is not enough to get PR call. Thus I need to get 200 points to secure PR call. 200 points from new NOC 00.
Questions:
1. If my employer agrees to do LMIA and I apply WP under category 00 (Sr Executives or Sr Managers), will I loose my previous exp# score of 15 points in my current FSW score? Or will I still be able to have them when I change to my designation? fyi...My role is still the same, only designation gets changes.
2. If my employer doesn't go for LMIA for WP and only goes for WP under ICT (which is LMIA exempt category), will this give me any point for Arranged Employment under FSW?
Suggest?
