LMIA for job offers for people outside Canada

I have some questions which might sound strange. One of my friend in US(non-american) is getting job offer from a MNC in Canada. The employer will probably be doing the LMIA (which probably is almost mandatory to hire people from outside Canada). But he will be joining couple of months after getting visa/lmia. Few questions:

1) After getting the LMIA, but before joining the company, can he apply for EE and get 600 points?
2) Will he get the LMIA or only the company will get it? I believe it would be some document (hard-copy). If he doesn't get it can he still use that LMIA for EE points?
3) After getting the LMIA, if he decides to join some other employer in Canada, can he do so?

hhaa..haa.... smart guy I must say ;D especially with Qs 3.

So your friend can apply EE but needs the LMIA details handy. If employer is generous enough to share that with employee joining the firm then for sure, yes !

LMIA is processed for a particular position for a particular employer. Getting LMIA from one employer and joining another company - that would be a little too much :eek:

I think employer can file LMIA for TFW or PR or both. However, for TFW he should pay $1000 and for PR there is no fee. I would recommend employer filing dual so that LMIA can be used for TFW and PR application.

Employer will apply LMIA and ack will be sent to employer back. Generally this copy is needed to apply the work permit. So employer shares this with candidate. Till now, while filing data in EE you have to enter the details of LMIA.

3) After getting the LMIA, if he decides to join some other employer in Canada, can he do so?
Till the person gets PR, if he decides to move on to other company, new employer should again file LMIA and get it +ve. So work permit has to be applied again.

So usually employer shares the LMIA copy with the applicant (for work-permit application). Does the Express entry require that the person with LMIA be currently working in Canada(and working for the employer who did the LMIA)?

Basically my friend has a genuine Canadian employer who is very interested in hiring him, and the employer would do the LMIA. But my friend isn't very sure right now if he will join them (he will be able to decide after few months based on some external factors). Meanwhile if he asks the employer that he is willing to join and gets the LMIA filed, would that help him in Express entry (if he doesn't join that employer and doesn't enter Canada)? Or it would be just a wastage of time/money for him and employer.

I know this sounds unethical and waste employer's money(but he will pay-back the expenses to employer and/or complete some projects for free for them). Is this something practical? Will the LMIA count for express entry?

Oh boy, do I have an opinion. An employer goes to all the trouble and potential expense if the LMIA is for a work permit as well as EE, and the employee has no intention of working for him!? I haven't seen anything that would stop this from happening, but you can be sure if it becomes a rampant problem there will be even fewer LMIA's for bona fide applicants.

The employer has to advertise in a number of locations for a minimum four weeks and continue to advertise until LMIA approved. The employer must prove no local applicants and provide business information. You can google or search on cic for LMIA guidelines.
