Hi guys!

I just got to know that my work permit got rejected, even though my LMIA is approved. But basically, I can't work in Canada anymore. Apparently it's the officer's mistake as he messed up my file. My company is reapplying for a new work permit as well as revoking my file for the rejected work permit. I heard that I can go to the border and talk to the people over there. And if they find my case genuine then they can give me my new work permit. Is this information true? Can I really do that?

Thank you.

I will appreciate any response I get.

An approved LMIA doesn't guarantee that your work permit will be approved as well. What were the reasons given for refusing your work permit?

Whether you can go to the border to obtain a work permit with your approved LMIA depends on a number of things. Do you hold a visa exempt passport? If so, then you can try going to the border. If you hold a non-visa exempt passport, do you hold a valid multiple entry visitor visa and do you still have valid status in Canada? If so, you can try going to the border.

The refusal letter that they sent, stated that it got rejected because I don't have an approved lmia, which is weird because I do have it. I talked to a CIC person and she checked my file and said everything was proper on my end. The officer didn't check that I had lmia and he rejected the work permit. This is clearly their mistake and they are rectifying it. But all I wanted to know is if there is anyway I can start working again. I don't want to wait for the whole process again.

And you are right, I can't go to the border as I don't have any of those things. I am now on restoration and am not from a visa exempt country. It just sucks that I have to suffer from someone else's mistake.

Thank you so much for the reply.

Unfortunately you can't work during restoration. You'll have to wait until you have a valid work permit again.
