Hello,
I recently got my ITA and I am currently preparing my documents. I have already got the FBI clearance certificate here in the U.S and I am not sure If I need to get one from India too. I have herd from one of my friend that, his application got rejected as he didn't submit the Indian police clearance certificate even though he is living in the U.S for the last 5 years.

Please let me know your thoughts.

Thank You.

Who needs a police certificate?
In general, you and all the people in your family who are 18 or older need to get a police certificate.

You may need a police certificate from any country or territory that you have spent six months or more since the age of 18.
(so if that is India for you, then yes you need to - http://www.cic.gc.ca/english/information/security/police-cert/asia-pacific/india.asp)

For example: if you visited, worked or lived in a country for two months, left for a few years, then returned for four months, that counts as spending six months there. In this case, you would need a certificate.

If you need a police certificate from a country or territory and:
  • are currently living there, or received the police certificate before leaving, the police certificate must be issued within six months before you apply.
  • have lived there in the past, the police certificate must be issued after you last lived in that country or territory.

Hello,
Thank you for your reply. I have moved to U.S.A in 2012. So, I am assuming, I need to get the certificate from India. Is that correct ? Any idea on how to get one while staying in U.S?

Also, the FBI clearance certificate we get here in the U.S.A, should it be more recent ( 6 months ) or can it be longer than that. I have got mine in April - 2017.

You might be cutting it too close. If you currently live in the US, your US PCC can't be more than 6 months old at the time of submission of your eAPR (electronic application for permanent residency). Depending on what date you got it in April, the PCC is either already more than 6 months old, or will reach 6 months by the end of or during this month, in which case you'll have a problem...
