Living in the US and applying in home country.

Hi. I live in the US and I will so apply to immigrate to Canada. However, I will be applying in my home country and not here in then US (Bufallo,NY). The reason is because the application is processed a lot faster in my home country. But I read in the CIC Website that you must apply in the country you reside in. Can I apply in my home country and still give my US address? Will they send me the application back to me asking me to apply in here in the US?

Where do you come from? As far as I know cases in US are processed in a short time. Applying from the country you reside in can be chance, especially if the process takes a longer time in your homeland.

If the time frame is not of much difference apply from the US.

I am from Brazil and in Brazil the time frame is 13 months. The reason I am also applying in Brazil is because I do not carry a legal status here in the US. I just want to make sure that applying in Brazil e living here will not be a problem.

You always have the right to have your case processed in your homeland and if you are not legally admitted to the US for one year, say you were there on a 9 month work permit, you would have to apply in your homeland. How exactly the visa office in your homeland will deal with it is a different question. They may be able to mail your documents to the US but if they request an interview, I think you have to go to Brazil.

On the CIC website, it says:

Applicants for Permanent Residence
You must apply in your country of residence, your country of nationality or the country where you have been legally admitted for at least one year.


This is from http://www.cic.gc.ca/english/information/offices/apply-where.asp so you see, you always have the right to apply in your country of nationality.

Actually no, if you are applying for PR card, you must do it from inside Canada. If your PR card expires while you are in another country, you have to apply for a PR travel document to go back to Canada and then you can apply for PR card.

As for applying for PR status, see my answer above, you must apply in your country of nationality or where you are a resident or where you have been legally admitted for 1 year.

It's usually one or two countries, country of nationality and the country where you live.
