I all off a sudden started to panic a little here. I have travelled back to my own country to sort out my addresses so I could obtain my IEC visa. It was a total of 3 weeks that won't hurt would it?! It was out of the 12 months.

It's a tricky question, and it really depends on the officer who opens the application. Some officers will say it's OK. Some will consider that it's a breach of the 12 months, and thus, you don't qualify as Common-law. On this forum, people have had both cases.

So - since you're inland, you won't know until they give you the first stage approval. For outland applicants, that can be determined already at the first stage.

Hey Sweden what if the officer think its not ok, what would happen then?
And I mean it's on the stamp and we are already inland like you said.

It's a very confusing situation too.. Because I obtained my IEC visa on February 11th 2012 and we sent away the application (for PR) on that very same date (february 2013) and it was received in and around that date (I don't remember the exact date they received it but it was after the 11th for sure)

It's difficult to know what will happen.

I can only tell you what has happened to some people that posted here ( and were outland applications, not sure it makes a difference). Because there was a break in the cohabitation for 3 weeks, they didn't qualify as common law and their application was returned. They had to wait until they qualified ( 12 months without leaving the country), and re-send the application then.

I may have confused myself here.
I obtained an IEC after returning back to Canada from Denmark which i activated in February 11th and that ran out February 12th this year and we just mailed the PR inland application a few days later than that I'd say they probably received the application on the 13 or 14th of February so we'd be able to pass, right? I didn't leave at all when I was on my IEC visa and we managed to both sign 2 leases for each 6 months with the same address!

And we explained them how I lived at his moms for a few months before we got our own place as well!

We sent our application exactly 1 year after we moved in together. Now my questions:

In August 2012 we went on a short trip to Florida to meet my family who was on vacation there. He only got 5 days off so he flew back and I stayed 5 days longer (plane ticket was booked long before I knew him).
In March 2013 I had to fly back to Germany for 7 days because my work permit expired and I had some important meetings at the bank, insurance and the city hall (had to go there in person). On the way back I activated my new work permit. He didn't get the days off to join me because he's in the golf business and the only time he can go on holiday is in December/January. The 5 days off in August were a big exception.

Could it be a problem because we were apart from each other for 5 and 7 days within those 12 months? He already got approved as a sponsor so I guess everything is fine? I never thought about these short times apart until Line.a posted this topic here ;-)

for 5 and 7 days it should be fine. Short absences are allowed - and if he has been approved as a sponsor it means that CIC decided that you qualified as Common law, so there should not be an issue with your case. Also - obviously he tried as he also went to Florida with you, and you going back to Germany for a week to take care of administrative issues before coming back to Canada should not be an issue either.

Thanks Sweden, I hope that they're ok with my short absences :)

My co-worker who applied through London got a message last week that she has to send more proofs that she and her boyfriend have lived together for 12 months. He got sponsorship approval in March 2013.
