The update for this week Dec 1st is still 10-11 months processing application received up to Jan 4. Guess they are moving now cos they dont wanna exceed 11 months for just AIP. I'm sure we will get there oneday.

@monalizy- sorry for our dialect, we are talking about the Joy sioson, the one who fought for the tejada law, i am just askiing if we can just call her and let her know the situation of the processing times, if you want to we can call her too, i hope everything wil be fast after the holidays! it is so hard to be away from our families!

@mydesire- i tried calling her yesterday(Joy Sioson) noone is picking up, i am so desperate for this processing ! god bless us all!

Hi everyone, just wanna know when did they implement the "no medical" thing coz I recvd my OWP recently and I have a letter which asked me to have a medical exam.I submitted my papers Jan 2010,and opened march this year.hoping I could get some advice.tan

@jennix- it was implemented last april 2010, so you will have your medical? can you post your timeline? are you single or with dependent? i am just wondering you just said you had your open work permit last march? o that is so quick! hoping for your reply thanks!

@rosellyalung: no,i got my OWP just few days ago. i submitted my papers last jan 2010,they started processing it mar 2010. i received my OWP dec 2011,with the letter that is requesting me to do a medical examination.the thing is most of my friends who have recvd their work permit recently doesn't need to do medical.

The changes are a result of changes to the Immigration and Refugee Protection Regulations that came into force on April 1, 2010. Section 30(2) of the Regulations provide that:

(2.1) A foreign national who has applied for permanent resident status and is a member of the live-in caregiver class is not required to submit to a medical examination under subsection (1).

However, while a medical examination is not required, an officer does have the discretion to order one. Operational Bulletin 232 specifies how this discretion should be exercised. The Bulletin states:

* Officers should only consider requesting that a live-in caregiver complete a medical examination as part of an application for permanent residence if the officer has reason to believe that the live-in caregiver has a health condition that is likely to endanger public health or safety.
* Should the officer believe that this is the case, then the officer shall consult with National Headquarters / Case Management Branch on the details of the case in question for consideration prior to requesting that the applicant complete a medical examination.

* Where a live-in caregiver has already completed a medical examination as part of their application for permanent residence, and is currently in the stages of procedural fairness correspondence based on a medical notification indicating inadmissibility due to excessive demand, then the officer should consider whether an exemption of the inadmissibility may be warranted on humanitarian and compassionate/public policy grounds.

* Should NHQ/CMB indicate that a live-in caregiver should complete a medical examination as part of their application for permanent residence, and the caregiver is subsequently found to be inadmissible on health grounds, then the applicant may choose to request consideration on humanitarian and compassionate/public policy grounds. Further consultation with NHQ/CMB will be undertaken prior to refusal of any such requests for consideration under humanitarian and compassionate/public policy provisions.

Call CIC and clarify the medical request. It probably is an oversight on the part of the officer who processed your documents. The following are posts from other members who submitted PR apps in 2009 and did not have second medical:

@ rosellyalung - Hi! I called CIC & I was informed that they already sent the file of my dependents in MANILA Oct.29 but up to now they haven't received any yet from the Embassy of Canada in Manila. My Open Work Permit has not arrived yet as well but I am hopeful that in God's time it'll all come :)

Hi, girls!

Hi, girls! I am a single Live-in caregiver waiting for the OWP and the PR. I sent my application on Lune 28, they received it on June 29 2010. Still not on eCas...
I have a question here that might be interesting for many. When I was getting ready to come to Canada and had to go through the medical in my home country, they found a scar on one of my lungs. I had to go through different tests which proved that it wasn't tuberculoses, but the suspicion remained. I was given my work visa but they also gave me a paper saying that I had "inactive tuberculoses" and I had to contact the nearest tuberculoses centre after coming to Canada for some more tests. I had X-rays, and some other tests. Negative.

OK, on April 1 they decided that it wasn't necessary for the caregivers to go through another medical, but it's in the power of the officer to decide that. The TB is a very scary word here. What do you think they will do with me? Has anybody heard anything? Does anybody know anybody with the same problem?

I will appreciate every word!

thank u guys,that helps me understand more clearly. i'm just wondering how they would know that a caregiver is not in good health. Is it possible that they check your usage of your ohip card?
