Letter of reconsideration due to misinterpretation of info

If the letter is dated in March 2012, they cannot give you credit for work beyond that date. You should have gotten another letter with a later date to prove you completed 2 years. A letter that indicates "you will complete" or "you will have completed" is not enough.

Well, you have nothing to lose by requesting reconsideration, but you should get a new letter from your employer verifying your full period of employment, otherwise there will be no chance.

CIC instructions are to provide a "recent" letter - yes, that is vague, but the letter should NOT be dated BEFORE you complete your experience requirement, because then it doesn't cover your full period of employment. CIC will only give you credit for the time period covered by the letter. The letter cannot cover "future" experience that hasn't happened yet.

Yes, CIC could contact your employer to verify continued employment, but (a) they are only required to consider the evidence you supply, and (b) why would you want to create extra work for them? That will only slow down processing for you and everyone else.

I'm afraid the VO did his/her job correctly. But you could get lucky, let us know how it goes.

Hi jes_ON,

I see your point on this. Actually the employer that I worked for was already closing at that time, that's why we requested for an earlier employment letter to them. Fortunately, I did got a hold of them and ask for a new one. Well, I never thought that this will be an issue since I also submitted my paystubs to them and also Record of employment together with my application. I guess I have to try this one. If not I will reapply and work experience wont be a problem to me anymore since they change it to 1 year and also I'm currently working as well to same NOC to another company that hired me.

Thanks for your input on this. Would you know where to send the letter? is it on 219 Laurier Avenue West, 7th Floor, Section B Ottawa, ON?

Hello jes_ON,

Fortunately, eventhough its difficult to reach them, I did get a hold of them and asked for a new employment letter. I did not think that this will be an issue since I submitted my pay stubs as well and my ROE together in my application. Obviously, VO really only focused on the employment letter and did not considered the dates that I filled out in the application form and supporting documents. Well, I have to try this reconsideration first. If not I will just reapply and it will not be an issue anymore since they changed it to 1 year and I'm currently working in the same NOC in different employer that hired me.

Do you you know where to mail this letter? there is an address that was indicated in the refusal letter. 219 Laurier Ave West....

Thanks for your input on this.

Thanks for your input on this. I did have a hunch that this might be the reason. It really did shed some light. Since I was really frustrated why the VO interpreted March 27 to be my end date while if your going to read the letter it was clearly stated that Im still working at that time and completing my hours. Do you think I still have a take on this since I already obtain a recent employment letter? Not sure now if I have to submit the letter of reconsideration or just reapply. :(

Thanks for this. So if you were me. You will not bother to send a letter of reconsideration and just reapply right away? Kind of confuse what to do now....

1) Immediately get latest reference letter from your employer and send it to CPP-O for reconsideration. Try your luck
2) Also start preparing new application...a) get your IELTS score card b) start PCCs

No point in wasting single day....and look for all avenues...

Hello pjcanada,

Thanks for this advice. These are the things that I am actually doing right now. I did obtain a new employment letter. I also did a reconsideration letter and also Im already gathering documents for the application. So, I guess I have to try my luck then =) Do you think how long should I wait for their reply from the letter of consideration that I will submit before reapplying? Is 1 month reasonable enough?

Thanks so much =)

Yes they typically reply in 2 weeks time. So wait it out for a couple of weeks, if they don't get back, I would suggest re-applying immediately. If they favorably accept your initial application even after you have re-applied, you will be allowed to cancel your second application. Two open applications are not allowed.

ontariopr, if you are re-applying, make sure that your ielts score is not more than 2 years old...else you can order an additional copy by referring to the below link:

http://www.ieltscanada.ca/trf.jsp

the process may vary a little bit depending on the location you gave your test.

You have to re-apply for your PCC from all the countries where your stay has been more than 6 months (except Canada). But you can always submit your app without the PCC and can submit PCC once you receive your AOR.
