Letter of reconsideration due to misinterpretation of info

Hello Guys,

I just want to know if anyone knows where to send the reconsideration letter I made, where should I address it to and to whom. Is is to Program Manager. My visa office is in Ottawa. My case was refused due to misinterpretation of the letter of employment. I got the refusal letter last April 4th. I am a July 2012 applicant. Its so frustrating to wait for 9 mos just to get a refusal letter due to the error at their end. I already sent them an email on April 5 regarding this however, I did not receive any reply from them. I am planning to send a notarized letter of reconsideration. Want to make sure that I am sending it through regular mail in the right address and person.

Greatly appreciate your reply regarding this.

I would suggest you going to your local MP and take their help,,,,,believe me it helps,,,

I hope it is 'mis-interpretation' and not 'mis-representation' of info, the reason for rejection.

Sorry for not specifying the details.

The refusal is due to lack of work experience. My employment letter was dated March 27, 2012 (located at the upper left of the letter), basically Marc 27 only implies that the letter was made at that date. The officer interpreted that date as my employment end date. My employment end date is May 18,2012. So basically I am short of 2 months from the required 2 years of work experience in CEC because he misinterpret my employment end date as March 27. It was clearly stated that at that time I am currently working to that company.

So tell me guys, is this misinterpretation or mis- Representation?

I will try a letter of Reconsideration first, see how it will go. If not, I guess I need to reapply and wait another 9 months =( That's why I need to know the right address to send it. Who am I going to address it too. Is it to the Program Manager?????

MP stands for member of parliament and u can search it by your postal code,,,,

Can u please copy the email which you received from the visa officer so that we can interpret the exact reason for your rejection.

Well, you have nothing to lose by requesting reconsideration, but you should get a new letter from your employer verifying your full period of employment, otherwise there will be no chance.

CIC instructions are to provide a "recent" letter - yes, that is vague, but the letter should NOT be dated BEFORE you complete your experience requirement, because then it doesn't cover your full period of employment. CIC will only give you credit for the time period covered by the letter. The letter cannot cover "future" experience that hasn't happened yet.

Yes, CIC could contact your employer to verify continued employment, but (a) they are only required to consider the evidence you supply, and (b) why would you want to create extra work for them? That will only slow down processing for you and everyone else.

I'm afraid the VO did his/her job correctly. But you could get lucky, let us know how it goes.

According to the rules, you need to qualify on the day you mail your application, not at a later date regardless of what the letter says. You should have obtained a newer letter for 2 more months to complete 2 years because from CIC's point of view, you only worked for 1 year and 10 months. They judge based on established facts not on predictions of the future.

yes, I did qualify since I am already working for 2 yrs and 1 month exactly on May 18, 2012...I submitted my application July 6 then they received it on the 10th of July.
