Dear Friend,

I am from Kathmandu, Nepal. Me and My wife both are Canadian PR since August 2010 but I have only stayed there for around 2 months and my wife atayed there for around 7 months and returned back to Nepal.

-> In between we got female baby.

-> Now she is 12 months old.

-> As you have advised in previous post I had applied TRV for her but refused.

Now I am in plan to apply TRP for her. I have gone through the website: cic.gc.ca but I was not been able to find proper form and procedure because I found that the form available there is for those who want another TRP and want to remain in Canada.

Because of residency obligations, there is no more time with us. So please waiting for your expert openion.
Thank you in advance.

What is the reason for refusal? Why did you apply for a TRV or TRP for her. As a PR you should be able to sponsor your baby. Your short stay in Canada after getting PR in Canada raises a red flag.

Information on how to apply for a TRP can be found here:

http://www.cic.gc.ca/english/information/inadmissibility/permits.asp

"You should submit an application for a temporary resident visa along with supporting documents to explain why you are inadmissible and why it may be justified for you to enter Canada."

Thanks for your response, actually the Permanent Resident residing outside can not sponsor the child. One of us should be there but we want to take our baby along with so we are trying TRP.

Please do advice if you have any expert knowledge on this.

Scylla,

Thanks, I have already gone through the link but have you seen the page? There is no information about TRP.

Raja ji,

Actually there are so many reasons coted. I guess, TRV is for those who will returned from canada after some time but in my case, I am trying to make by baby to stay longer as a permanent Residence.

So they have refused my daughters visa.

This is LITERALLY the first sentence of that guide:

This guide is for persons who currently hold a valid temporary resident permit (TRP)

Your daughter does NOT hold a valid TRP, so you can't use that guide. Scylla gave you the right guide.

Honestly, I would apply for your daughter's permanent residency in Canada, and THEN apply for the TRP. However, one of either you or your wife would have to go to Canada first, since you are only PRs and not citizens.

Sarojji:
Can you post the reasons of refusal? However, I do not think TRV or TRP is a proper option for your daughter.
You have mentioned in your earlier post that both you and your spouse are Permanent Residents. How did both of you get PR. Did you sponsor your spouse or you were sponsored by your spouse? IMO, best option is to sponsor your daughter. You or your spouse or both should go to Canada and start the sponsorship process.

Dear Seniors,

Thanks a lot for your concern, Actually the process you have suggested is very much true but I have listened many cases, also in this forum that the people use to apply TRP for child, if this situation happened and this is the best way to take baby alongwith than we can sponsor the child after reaching there.

As suggested by "Scylla" the page has only described the process but conclude with TRV and the same was refused previously.

I am the principle applicant and we both got PR as a Federal Skilled Worker.

Moreover,

LEON has suggested me to "Try TRV, if refused than try TRP if visa has not been granted again than only one of us have to move towards canada to sponsor our child."

In this guide, here is some code,

http://www.cic.gc.ca/english/information/applications/guides/5554ETOC.asp

Family members

Family members (spouse, common-law partner and dependent children) travelling with you are also inadmissible and may or may not be issued an initial TRP. If the officer forms an opinion that it is justified in the circumstances for all family members to enter or remain in Canada, then each family member will be given their own TRP and they are each permit holders in their own right.

Please friends I need proper guide and forms for TRP.
Thank you once again.

Sarojji: Temporary Resident Permits are not easy to get. Here is some information:
Temporary resident permit:
A permit that may be granted in exceptional circumstances to a person who does not meet the requirements of Canada's immigration law to enter or remain temporarily in Canada.

The link I have posted earlier is for the Form and it opens fine for me. Since you are in Nepal, I am sure you have to apply at New Delhi, India.
