legally separated / Divorced status - queries in application

Hi,

After receiving ITA, am in the process of application.
However, I have filed for Divorce at the court (India), and I need to wait till March. The court has given 6 months period of time to legally issue divorce certificate. The court sealed document where me and my spouse have signed agreeing for mutual divorce, is received when we filed for separation last month. So this gives me the status of legally separated or divorced?
As I need to submit my application in a month, I will not receive final divorce certificate by then.
Since I have the above mentioned document with seal from the court, I need not submit medical or other documents of my spouse during application right?

Please help me here. Your suggestions would be very helpful at this point of time.

Hi

You are legally separated, as the divorce has not yet been finalized. Include proof that you have filed for divorce and a letter of explanation. IRCC may accept that or they may request proof that the divorce has been finalized before approving your app.

1. By the way, in case IRCC request for the proof of divorce finalization, do you think they will reject my application or keep it on hold till i submit my divorce certificate?
2. Also, if the status is legally separated, I will not have to provide details like PCC, Medicals etc of my spouse right? (More or less application documents required will be like that of an applicant with status 'single'?)

1. They shouldn't reject the app. If they give you a deadline, you could request more time for the divorce to be finalized and they would likely grant it.

2. IRCC may still request everything for your spouse, as Legally Separated is not the same as Divorced. As you have proof of filing for divorce, it is unlikely that they will request anything for him.

One last question, in the family information slot : I have given the option as " legally separated" .
Then when I am filling the marital status under "personal description"; it asks for "How did this relationship end?". The options here are like: annulement, divorce, death of partner, end of common law. I think only divorce can be given here right?
Nothing like "awaiting divorce" could be found.

If there is no option for "Other" where you can put a little explanation, then just put "Divorce".
