Legal name change document request

Hey there,

My wife and I have been living in Calgary for 3 years on working holiday visas - we both have British and Irish passports.

We got married in Calgary in October 2016 and have recently began an application for PR through CEC but a legal name change document is being requested. We had our first PR application refused due to being incomplete (work experience letter not acceptable) and I do not intend on the second aplication having the same outcome.

My wife's British passport is still in her maiden name but her Irish is in her married name. All Canadian documentation has been changed to married name such as: Driving licence, SIN, Tax return etc.

My question is, what documentation can I submit that they would find acceptable?

For our current application, my wife submitted an "One and the Same Person Affidavit". We have it notarized and you can create your own format following some guides in the internet. Usually if you go to nearest law office they also have their template or format for an Extra Charge.
In the affidavit, it says the details when we are Married, Her maiden name was XXXXXX and after marriage her name was changed to XXXXX New Surname. You may also add/declare all documents that have used the new changed name(Married Name) and that all are one and the same person...

We also added an birth certificate to prove her Maiden name.

It appears she is legally required to have the same name in both passports (from the UK perspective), so, suggest submitting a name change for the UK passport.

You could submit proof of the application for the name change, followed later by a copy of the new UK passport...

We held off on applying for a new passport because of travelling on our visas which is why it hasn't been updated already.

If we were to apply for a new passport, when it's received, were would we have to upload it to? Would a notarized affidavit along with government issued paperwork showing married name and birth certificate not be suffice proof?

Those 3 documents should suffice the original additional request which is the "legal name change document" .

Just my suggestion, if you already applied for the new passports, you could scan copy the application receipt proving that its in process already(while waiting for the new passport). Combine it will all the others in one file, and upload on the place holder of "legal name change document" in your EE profile.

Well, that would be proof that she is the same person (not what they asked ) - it is not proof of a legal name change.
Did you not already submit the marriage certificate, which showed both names? For some reason, this is not good enough.

The problem you have presented to Canada is that with the different names in two passports, she has two legal identities and they need there to be only one...
