Legal Aid Refused Options? NEED TO FILL BOC

Hello

i came into canada on student status , finsihed years ago, application for restoration got refused.

I cannot return to my home country as I am fearful of doing so and want to file a refugee claim

Unfortunately legal aid ontario refused the app as they said i came in as a student

Is there any help I can get in toronto? or even montreal?

i need to fill in the boc asap and give it in as my restoration was refused not too long ago

need anyones help pleeease?

How long is it since you had legal status in Canada? Sounds like you have been overstaying for a while.

According to http://www.legalaid.on.ca/en/getting/type_immigration_supportref.asp they will state "If you are financially eligible and your matter has merit, LAO may pay to:". Presumably, you fail to pass one of those requirements.

You could hire your own lawyer. Is suspect legal aide feels since you finished years ago and were refused restoration, you are a refugee of convenience. They probably feel there is little chance for a successful claim. I've seen posts here where they refuse to continue service if they feel there is no grounds for a successful claim/appeal.

my case has merit, it was refused because of their "financial eligibilty" saying that I came on student status and they dont provide aid to those that come in as students

no i have not overstayed for a while, i was on student status which changed to visitor and a request for visitor restoration was denied a few weeks ago (less than 3)

so i would say i have been "out of status" for less than 3 weeks or since the initial application for extension was refused.

You can fill the BOC yourself. It is quite self-explanatory. Still, if you can, get a lawyer at least for the hearing.

since I am out of status, would going in to a ircc office to hand in my forms result in a removal order? I am scared of this. pls help someone.

You need to read the information available on the IRB's webpage. Watch this video:

Yes, you will be given a Removal Order, this is given to every person that applies for Refugee from within Canada because, in theory, you should not have applied from within Canada.

However, the removal order is suspended immediately pending the outcome of your refugee hearing.
