Hello,

I was just wondering...

My husband was in and out of Canada during 2012 and has been here from Sept 2012 - present. He wants to go back home and work until his papers have been processed. We are still in the works of getting medical exams done for him and his son. If he decides to leave now can he get denied to come back into Canada if he gets approved for his PR in let's say 2014??

Hi,
From personal experiance, if he leaves while the application is in process to go work 9 times out
Of 10 he will get denied because they see that as unfit commitment, I was told if I did that they
Would deny me and I just wanted to cross the boarder to work!

Yea I figured that would be an issue. Thanks for letting me know :)

Just a quick question if you don't mind. When we complete the paperwork do we fill it all out and send it in all at once? How do you obtain your UCI#?

Is he the applicant or the sponsor? And are you applying outland or inland?

If he is the applicant and you are applying outland, then it's fine. When he gets PR, he legally can come to Canada so it's not an issue.

He is here and is the applicant and I am the sponsor. We are actually applying inland. So would you all suggest for him to just stay put here?

You can apply outland even if he's in Canada.

That said, if you are applying inland, then yes. If he leaves, your application gets thrown out.

Believe it, it's TRUE! I had a very hard time with this concept when preparing ourselves to apply - but we did, and now we're there! I'm reinforcing parker simply since I know it can be a difficult one to buy into. Sounds like it would best suit his/both your needs. Go for it. Apply "outland"!

So if we apply outland would he be ok to still leave Canada? In most cases even though he is here would you more or less it's best to apply outland? I am just trying to grasp this concept lol! But I appreciate the help!

Been the topic of many a debate here on this forum. But I can honestly say "in most cases" yes, and especially so if your circumstances allow you that choice.

Suppose he is from visa exempt country, then he can travel back and forth without almost no risk (no guarantee though) if you apply outland. That's one of virtue applying outland that the applicant can travel in and out of Canada. I have been in Canada for the past years and applied outland and during the processing time, I traveled outside of Canada. No problem. If you apply inland, he should not leave Canada.

There are some pros and cons for inland and outland applications. You want to review them before applying. But you have both options to consider.

be careful. Just because a country is visa exempt, does not mean it will stay that way. (Mexicans started requiring a visa March 2009)

Entrance to Canada is never guaranteed !

We are not going to take any chances in coming and going. But we will do the outland application. He is from the US and at the same time he does not want to jeopardize our application or the fact that he will get denied at the border.

Now he had his passport stamped back in September. We will be sending in the application next month but I should still get him to apply for an extension of a visit right?

If he was admitted for 6 months when he came in last time and he wants to stay beyond the permitted stay, yes, he needs to extend his visitor status.
