Leaving Canada temporarily for 1 year after submitting PR Application to CIC

Hello,

I received my Provincial Nomination from Alberta under Post Graduate Worker Category, this January. I have applied to CIO, Nova Scotia office for my PR under Provincial Nominee program. My application includes documents of myself as a Principal Applicant and my wife as my dependent (she is currently in Pakistan). While applying to AINP, I submitted as myself being principal applicant and my wife as my dependent, and I got nomination.

Due to some personal family reasons, I have to leave Canada temporarily for at least 1 year. My question is can I leave Canada while my PR application is in process with CIO? If so, is it possible that CIO send my medical to be processed from Islamabad embassy? Or having filed my case inland, i need to be inside Canada for the entire length of processing.

I would greatly appreciate if someone can guide me in this regard. Thanks to everyone in advance. :)

Hi Chemguy89
First of all the province nominated you because you are working for the province and paying taxes but if you are not doing so they reserve the right to revoke your nomination anytime.
Second thing AB immigration can ask for your paystubs anytime they would like even after nomination.
So according to that continue you work. You can go outside of Canada but only for holiday.
I went back home for a month= 4 weeks.

It will be a big mistake if you go back because you are a PNP applicant and not a CEC applicant. Which means your province nominated you fast while you are working and CIC looks at the nomination letter.

Keep in mind being nominated by a province does not mean your application for PR is approved.

Please consult other members.

My suggestion is keep working and go for holiday only so that if CIC ask you about the reasons you can explain that was family visit and your work is full time.

SK immigration audited my employer after 1 year of nominating me while my file was processing in Ottawa. Also CIC asked for my 6 months paystubs in March.

Do not want to disappoint you but it will another year or so by the time your wife will be here. :)

All the best :)

Thank you so much for your advice and insight on my case. I agree that being a Provincial Nominee I need to live in AB, Canada. As you mentioned in your post that it will take approximately one year for me getting PR, any idea how long will it take for CIO to send me request for medical? And as my wife is in Pakistan, how will we submit her medical?

One last question, if I apply for a visit visa of my wife this year and in parallel our PR application is under process at CIO, is there a chance of getting her visit visa approved?

Many thanks once again for your kind advice.

Deepdeep did great job answering your concern. Yes leaving for one year is a huge deal for CIC, imagine when you return and CBSA might even refuse the entry as they will find out you no longer met the criteria for the PNP.

When did you apply for PR? if you applied in Sep, Oct or nov or dec, be prepared to wait at least 4 -5 months for the AOR and Medicals, CIC will send instruction on how to do the medicals of yours and your wife as well.

Getting a visit visa for a wife is almost impossible, however if you have a PNP you get an open work permit for your wife.... I am not entirely sure of that process so do your research.

CIC will finalize your case most likely within 13 - 15 months after you send the application and assuming it's approved via CIO.

For Visitor Visa you need to be PR.
For WORK VISA check this out. I guess this is only available to student
http://www.cic.gc.ca/english/study/work-spouse.asp

Also I cannot really comment on your processing time as there is no processing time available for Pakistan and few other countries because there is not enough data available.

But just sharing with you I have 2 friends from diff province who applied for their spouse PR and they got here after 25 months. There case is little diff from yours. What I guess your wife will be here sooner but there will be little delay for your guys PR as processing time is not available.

All the best :)
