help me out with this question :

Schedule A: question 6(j): have you been detained, incarcerated or put in jail?

I was taken for blood test to police station, they took fingerprints and let me go. should i still answer "yes" to this question?

Were you under arrest at that time? Were you read your miranda rights and such?

yes, because you were technically "detained", correct? you were brought to th police station by police officers, either in or not in handcuffs and held there without the ability to leave, correct? to me, that means you were detained... perhaps i am wrong in this assumption?

saying yes to this question is not going to necessarily count against you. it will most likely lead to CIC probing futher as to "Why" and as others have said, how it "equates" in canadian law. It's always best to be truthful, not matter what it is. it's far better than being found "misrepresenting" yourself.

the fact your record was cleared doesn't change the fact that you have indeed been detained by the police at some point in your life.

Absolutely. Your DUI issue is solvable. Misrepresentation means a two year ban, if I recall correctly.

Del16, If I were you and decided to talk with a professional I would go to an immigration consultant not a lawyer. My husband and I talked with a Lawyer who was not able to answer our basic questions. We then were told by a friend of an immigration consultant he was going to use, we had a consult with the consultant and they were much more informed on everything and were fully able to answer our questions. I later learned that Lawyers even if they go into immigration law are given far less education on the laws and rules of immigration than an immigration consultant is required to know. Just my 2 cents worth. Good Luck

Thank you for a great advice. can you please tell me whats the best way to find a good immigration consultant? may be you can advice someone in toronto area?

Sorry we are in BC on Vancouver Island I have no ideas about Toronto. Maybe, talk to a Lawyer who does not do immigration they MIGHT know of a consultant. Since they don't do the work themselves it would not be hurting their clientele lists. Maybe there are some organizations that can help with the process of immigration that you can contact to see about a consultant or other assistance. In BC there is an organization called Intercultural Association that might be of help but I do not know if there is something like it in Ontario
