Lawyer adviced appleal to federal court_Urgent

Dear all,


Our PR case got refused due to INFANTILE AUTISM, AUTISTIC and due to the fact the immigration had asked us for addition documents from specialists that I submitted to the lawyer. But the rejection letter showing that nothing has been submitted to the immigration officer. Now the lawyer suggest to appleal the the federal court. I want to appleal the decision but I need more advice.

1. What are you going to appeal? Overseas VO office requested additional documents, it appears that the lawyer didn't submit them?
2. You can apply for "leave to appeal" to the Federal Court, but as you have a lawyer, s/he is probably willing to take your money to submit the "leave"
3. You don't have much time, and it all depends on what the refusal letter says as to the reason for the refusal. If it was because the documents weren't sent (make the lawyer prove s/he sent them) then you probably don't have a "leg to stand on"

Thank you for your reply,
With much pain, I dont really know why the lawyer has not submitted the requested additional info( I am not really sure if it was done or not!!!).
In the refusal letter it only says the I didn't submitted the requested information and the office has taken the decision based what he has on our file. Our child is 5 years old and autistic, but his improving much more in term of autonomy, I sent all the report showing the improvement to the lawer so that he could submit. And I dont really know the chance we have to win that so called appeal to federal court.

I think you should appeal to federal court
its without reason rejection
I know it bit costly but you should go for it
I got rejection without any reason then my lawyer suggested me to appeal
federal court was ready to settlement with me between 1.5 months
. keep all proof that u have submit your specialists .

1. Did you read the OP's reply? He doesn't know if the documents were submitted. CIC says they weren't and have refused the application. If the documents weren't submitted, then he has no case for the Federal Court.

I will get the Lawyer to prove that on tomorrow before I can decide for appeal.

Because I spend more time collecting documents which were requested by the Lawyer itself in order to submit to visa officer.

The Lawyer said that they didn't reply the fairness letter due to the fact that I requested for visit visa to go with my son there and find the

school and get a firm contract with the school for my autistic, unfortunately the visit visa application was rejected. This is the main reason for

leave application.
