Lawyer Advice - 2014 CEC PR Applications

OK, so I've spoken to 3 separate lawyers today to try and sort out my Work Permit/PR problems and explained my situation to all of them. In a nutshell, all were extremely unhappy with CIC and their behaviour in terms of how they're not being open and clear as to what is happening with the 2014 PR CEC cap and now the new EE system.

However, having read various rumours/facts (who knows?) on different forums, I've today been told the following regarding 2014 PR CEC by the different lawyers;

* The 8000 cap has been reached for 2014 and all applications after Oct 20th are being returned.
* The cap for '0' NOC codes has not been reached so there is still a chance for those applicants (like me!) - however, other applicants are receiving their applications back with the 8000 cap rejection letter.
* And one lawyer said there must be a reason why they haven't officially announced that 2014 CEC PR is capped. She started speculating that they'd mis-counted, they'd capped the wrong NOC codes, they were just trying to get people to stop sending paper applications and wait for the EE system, etc - anyway, the point was if the cap had been reached it makes no sense not to put out an official announcement.

I'm not debating what is and isn't right from the above list (as some of it contradicts each other) as it's been done to death on this forum in the last week but frankly, even the Lawyers are in the dark and guessing what is happening. So what chance have we got? Grin

I appreciate your efforts in getting connected with the attorneys. But do you think there is a separate cap for NOC '0'? It should be only one cap (of 8000) for CEC 2014 according to MI12 and additionally NOC 'B' has 200 sub-cap for each listed NOC code.

Totally agree. There are subcaps for NOC 'B', while there maybe no such thing as a separate cap for NOC '0'.
There is a seem-to-be official announcement published on a lawyer's website.

In the announcement it writes "The webpage on the CIC website where we indicated the number of applications received and counted officially against the overall cap at a given point in time was updated regularly but was only meant as a guide. In the list of applications received, we could not include pending applications that were complete but had not been verified yet in the total due to legal reasons.There was no guarantee that an application sent before January 1, 2015 would fall within the cap by the time it arrived at the CIO." Can this be taken as a duty-free announcement?

exactly there was info on CIC website that there is 8000 genereall cap and CAP for each CAP. but the general cap is the most improtant one!

The website you mentioned is not working(at the time i am writing this). I am waiting for one - just the single, one - announcement which states the CAP HAS BEEN REACHED. This is very frustrating for everyone. One single notice on government website can clear all the confusion.

Yes, i know people has started getting their application back and we are left with only one option EE. It would be very much appreciated if CIC could officially declare a statement.

Dude, forget the official announcement. Those officers are too busy to write it. You can consider the letter sent with the returned applications as a proof.

I called the call centre again today one last time. the agent mentioned that due to some legal reasons, they haven't updated on the website yet that the cap has reached.
So many of us have called cic now and they have all confirmed that the cap has infact reached as of oct 20th.
just start working on EE now guys! goodluck to all...
