Late Application - Jan/14 INTAKE

Hello fellow mates. I desperately need your kind words about my application.

Here`s the following data of our situation:

TRV (Visitor)
Issued in: 04/18/2013
Expires in: 09/79/2017

Landed: 09/25/2013

Permit (Visitor)
Issued in: 09/25/2013
Expires in: 03/24/2014

Study Visa Application (Spose)
Applied in: 12/19/2013
Late intake GBC: 01/10/2014

My wife`s study visa application has no reponse for obvious reasons, but our questions are:

1- There`s any chance, despite any other reasons, to get her application reproved because of late application? According to the processing times, I guess this visa would be issued like 15 days after the late intake on George Brown.

2- In case this visa get issued after the late intake:
a. It is possible to get the permit at POE without a letter of amendment allowing her to register late? (GBC denied this already) If its possible,there are any risks to being refused at POE because of this reason?
b. It is possible to get the permit at POE with a letter of amendment, changing the course and semester to May/14? Note that our Visitor Permit expires in late Mar/14. In this case, my OWP can be issued at the POE or I have to wait until May/14 to apply (at POE or online)?

Sorry my dear fellow, it was just a mistype. She have applied in 12/19/2013

I`ve edited the topic for further visits.

I`ll appreciate if you can comment about this particular case.

Your wife can't obtain her study permit at the POE - this simply isn't an option.

Scylla, thanks for your answer. I just didn`t fully understood it.

She CAN receive the VISA, but won`t be able to get the PERMIT at POE? I know that the VISA she can`t get it from the POE and that`s why we applied on the office.

My question is: With the VISA, can she get the PERMIT at POE after the late intake, stated on GBC LOA? As I said, the last date that she can be admitted is 01/10/2014. Let`s say that, with the VISA, she tries to get the PERMIT at POE on 01/20/2014, either with a new LOA for May/14 intake or WIHOUT any letter from college. The point is, on the actual LOA, its explicit that the last day to send the PERMIT to the college is 01/10/2014.

The permit will NOT be issued unless it has been approved by CIC first. Coming to the border with a TRV and a LOA from the college is NOT going to give her the study permit. She MUST HAVE the approval from CIC FIRST!

Maybe I`m not being clear enough: I know that WITHOUT authorization of CIC, POE can`t issue any STUDY PERMIT. Her Study VISA application is under analysis on CIC.

The problem is, 01/20/2014 is the LAST day that she can send the Study PERMIT to GBC, in order to attend to January Intake.

My questions are regarding the scenario in with she get this Study VISA AFTER this date, lets say in 01/20/2014.

POE can issue the PERMIT, even if she is already too late to attend class at GBC for January Intake? GBC denied a letter accepting her after 01/10/2014 and its clearly stated on her LOA.

Well, what is she going to do if the permit application is approved after jan 10? Go to POE and get the permit? Then what? You're saying yourself that GBC isn't going to let her start studying after jan 10 so she can't go to school. She won't be allowed to work either. So what is she going to do with a study permit she has no use of as the school won't let her study?

I really don't get what it is you are asking.

Edited to add: She MUST have the LOA at POE when activating the study permit. No LOA = no permit.

Its exactly what I`m asking. The point is we`re already in Canada and we don`t want to leave here before the beginning of her studies. Our Tourist visa ends in Mar-14, and with her Study Permit we`ll be able to stay here legally.

What we`re going to do is postpone to May-14 and wait here in Canada. At least that is the plan.

How do you intend to activate the study permit IF she gets the approval? You HAVE to leave the country and come back in. Is your TRV valid for multiple entries?

Our Tourist TRV is valid for multiple entries. We`re going to the border and re-enter Canada to try to get the Study Permit for my wife.

As a spouse of a study permit holder, I`ll apply for OWP on the border.
