Landing in Canada and PR card

Hi,

My name is Pradeep and few months back I've received my *Confirmation of Permanent Residence* for Canada, in which it's mentioned that my destination in Canada is Cape Breton, Nova Scotia (Dest:0429). Along with it I have received also a onetime entry visa for Canada that expires in July 2011 which means that I have to enter Canada before that date. Presently I work and reside in India and have no intention of moving permanently to Canada within the next months or maybe not even before the end of the year. My intention is to get into Canada, stay for few weeks (depending on how many I can take off from my job) and after that get back to my present residence in India.

From my understanding, after one has landed in Canada and intends to leave (travel outside) Canada (like my case) first must obtain a permanent resident card (PRC) that will allow him/her to go out and come back into Canada without any worries. I have looked on the internet and found out that the process of obtaining such a card can last from 30 days to more than 6 weeks in some cases, time that I believe I might not have at my disposal.

Based on the above I would like to ask some question hoping that someone could give me answers that could help me taking decisions


1>. Is it mandatory to land in your destination city (in my case Cape Breton, Nova Scotia) or could one land and settle (at least at the beginning) in a different city and obtain his/her PRC in this new location? The reason I'm asking is that I have friends in a different city that could help me out at the beginning.

2>. If the above answer is yes then can i land in " Pearson International Airport, Toronto" and complete the post landing formalities and settle in Toronto itself.

3>. Can you permanently settle in any city that you want till the PR is Valid.

4>. If my time would not allow me to stay in Canada until I personally receive a PRC, it would be possible to leave Canada, later obtain my PRC on my friends address and have my friends mail my PRC to me in Europe so that I could use it next time I intend to get into Canada?

5>. Is there a minimum Fund Required (CAD) while immigrating to Canada as per Rules.

6>. Also there are many codes mentioned on the "COPR" From point no 16 to point no 36, Is there a list where i can refer and understand these codes.

Hi Pradeep,

I do not have the exact answer for you but I do can tell you that lately the immigration authorities have been very picky with these situations. As many people is saying that they are going to some place and end up using it as a "toboggan" to land somewhere else, authorities are being very careful.

You just have to be aware you may get into trouble if your paper says one thing and you may be doing other (for instance... where is your ticket to NS?)

Just my 2 cents.

you do not need any PR card to leave canada; you will require this while re-enter as your immigration visa is one time entry which will be expired on your first landing. You may opt to leave and do needful to deliver the PR card once it arrives at your address in canada which you must have to give at landing for CIC to deliver your PR card (that is what I did)

Once you landed; you are free to settle anywhere in canada (I am not sure about Quebec)

Yes. You can.Thats what I did.

Yes. Plz refer to CIC for POF while landing depending on family size

Your ability to land and settle in another city than the one you picked depends on the immigration program you applied through.

If you are coming through the skilled worker program, then it doesn't matter as long as it is not Quebec.

If you applied through the Nova Scotia Provincial nominee program, you should land in Nova Scotia if possible or at least have a transfer ticket taking you to Nova Scotia from the city where you land. If the immigration officer believes that you do not intend to settle in Nova Scotia, they can refuse your PR or put you under watch for Nova Scotia PNP to check up on you when you move to make sure you are there, see http://www.cic.gc.ca/english/resources/manuals/bulletins/2010/ob251.asp

We are talking about landing. Landing is when you arrive in Canada for the first time with your PR visa. Your paperwork will indicate if you are a PNP applicant and of which province. If you land in another province, the immigration officer will realize that you are landing outside your PNP province. If you do that, they are instructed to ask you what your plans are. If you say that you are going directly to your PNP province and they believe you, that might be it. If you admit that you are not planning on going there, they will tell you that it is a condition of your PR and they may decide to withhold your PR card and notify the PNP you applied under. Your PNP might then call you for an interview to find out if you are at that point living in your PNP province or what your plans are. When you apply under PNP, you sign a document stating that you intend to settle in the PNP province. If you lie on this document, you are guilty of misrepresentation. When you commit misrepresentation at the time you apply for PR or when you land, they can revoke your PR.

As for people who already got their PR through PNP and decided to leave that province later, I have not heard of anyone who got in trouble for that but it is possible that might start to happen in the future. A few years ago, they were also not checking who was landing in their PNP province and who wasn't but one day they decided they wanted to start doing that. The document you sign for PNP doesn't give a minimum time you must stay but it is possible in the future if you apply to renew a PR card or apply for citizenship that if you came through PNP and are no longer living in that province that you will have to explain if you actually attempted to settle there and how long you stayed there for. Therefore, I would advise anyone who applied through PNP to make an attempt to settle in their PNP province before moving somewhere else.

Yes I did, they are still thinking about it. Meanwhile, I need to know if there is any way I can travel with my copr. My open work permit is still valid until March 2018. Can i use the trv/work permit to travel back to Canada in case I have already done the landing before leaving Canada?
