If your wife is able to find an employer willing to apply for a LMIA (Labour Market Impact Assessment) for her and if approved, can apply for a 'closed' work permit (i.e. tied to a specific employer). The LMIA is not easy to get with the high fee ($1000 or more) employers have to pay but not impossible if the person is highly skilled. Best wishes in everything.

My confusion is should we Appeal and how long does the appeal take or should we just start a new application.
I believe if they do interview us both together again and we produce the additional documents that we have a better chance. we really cant afford a lot at this time. Any though from anyone?

appeals are expensive and can take years. reapplying is usually what is recommended, especially if you can submit information that would overcome the objection of the rejection (ie: write a letter explaining why the sponsor didn't attend the interview and submit additional relationship proof). this isn't to say she won't get a second interview. it will probably just be quicker than appealing. of course, the decision is yours to make and both sides need to be evaluated closely to determine which is the best course of action for your file. i would recommend starting with ordering your notes and physical file to get an idea of what the original concerns were and why you were called in for an interview in the first place so you know what additional information will be needed to get an approval.

I am i n the same situation, my partner received an interview letter for LA and recommended I come along. We already got our plane tickets and I will be attending, but it says recommended. We ordered our case notes for $5 so that will have an idea of what it will be about when we get there. What was her interview experience like??

How much time did they give you, from the date you received the letter informing you of the interview, until your interview date?

I would strongly advice you attend. They were very hard on my wife because I did not attend and decided our marriage was for business as I did not attend! This seems ridiculous as we have been married for 14 years but that's immigration for you.
Bring lots of pictures and documents to prove you are real.

Another question is that most people do outland applications as its faster but what are the cons of inland since my wife is already here. Since our application has been denied I was advised to make a new application rather than appeal as the appeal process would take many more years.

I know she is not allowed to travel or leave Canada if I reapply inland for like 3 years but my outland application lasted 26 months! The pro for us would be if I reapply inland she can get her work permit and get back to work for 3 years and that would help to solidify our finances.
Does she need to keep renewing her temporary status for inland or is that covered since she cannot leave?
I am not sure what the others cons are for inland any help?

Unfortunately, the length of a marriage does not seem to matter given a Canadian woman was denied leave to remain in the UK (equivalent of PR) with her British husband because they don't believe her marriage is genuine yet she has been married for 36 yrs. Google it to read details.

There is a lady on the forum whose husband was denied and they had been together 10 yrs. If memory serves me well the reasons were they were not physically and financially compatible.

Considering most US/Canadian couples have a relatively easier process, there must have been some red flags if you had been married that long and your wife was asked to an interview. Not attending the interview going was a huge risk, and perhaps made the officer's decision easier. You were just across the border, no need for a visa, could ask for permission from work, leave your child with family/friends for a day, etc but you didn't attend - that would how an offand I'm assuming you didn't provide a written letter explaining why and providing evidence of any hardships? Imagine how it looks.

The other thing is the longer you are married, the more an officer is looks for a solid merging of affairs on all fronts because it's what is expected when a relationship is genuine and ongoing. Sometimes they ask for updated correspondence to assess if the relationship is ongoing. They are expecting to see progress - are you making plans, carrying them out, etc. 100 emails full of lovey dovey stuff is not going to impress them... even people in love have disagreements, talk about other things besides love, etc.
