Im having a hard time trying to keep track of my comments and replies to my comments...any tips?? Also another question...do you need to prove your income or make a certian amount to sponsor your spouse? I was under the understanding you dont but was told differently so now im confused?? ???

The simple answer is that no, you don't need a certain income to sponsor your spouse. In CIC terms, you do not need to meet a specific Low Income Cut Off (LICO) point in order to qualify as a spousal sponsor. However, you cannot be in receipt of social assistance for reasons other than disability, nor can you be an undischarged bankrupt. Furthermore, if your income is on the low end, and your spouse cannot show that they have income-earning skills (such as a job history, or a good command of the English language) you may run into a Section A39 situation.

Section A39 gives CIC the power to deny a spousal sponsorship if they feel that the spouse is unwilling or unable to support themselves and the Canadian sponsor has not provided adequate proof that arrangements not involving reliance on social assistance have been made to care for their needs. There was one such case on CanLII where the wife had no English language skills, had never worked outside the home, and her spouse himself had never held more than low-income jobs, did not have a home of his own or any significant savings. The sponsorship was denied and the denial was upheld on appeal, because in between the denial and the appeal hearing, nothing had changed in their situation.

Anyways, sorry if that was overly detailed, just wanted you to have a full picture of how the income thing works for spousal sponsorships.

kediesha, I wouldn't worry too much about the Canada post strike. Canada Post locked out the membership yesterday and is using roque workers to deliver the door to door mail, management is staffing the offices. This happens each set of negotiations. The government is considering back to work legislation for the postal and Air Canada workers as they are deemed essential services to all canadians. Typically they will appoint a mediator for both which will work with both parties to come to an agreement while the services continue as normal. Either an agreement gets radified or it goes before an arbitrator who while develop a binding arbitration agreement that will meet both parties somewhere in the middle. We can usally expect full services to continue within a week to 10 days, we will see a slow down but things will continue to move.

JillA - I found this information on the immigration Canada website about family class sponsorship. While kuma's post is from the guide and is correct about sponsoring family members, it clearly states the income requirement condition does not apply if you are sponsoring your spouse

•you have an income that is at least equal to the minimum necessary income, the amount of which is published yearly by the Canadian government.

You will have to provide us with documents that show your financial resources for the past 12 months and prove you are financially able to sponsor members of the family class. You may solicit the help of a co-signer (must be your spouse or common-law partner). If you reside in Quebec, see also Sponsors living in Quebec.

This condition does not apply if you are sponsoring only
◦your spouse, common-law or conjugal partner who has no dependent children, or
◦your spouse, common-law or conjugal partner whose dependent children have no children of their own, or
◦your dependent child who has no children of his or her own.
