My husband has to take ESL because he does not speak English. He grew up in the country, and only spoke Patois. But he is learning fast.. he says he now realize how important english is.

What you need to find out is if he had a one year ban or a lifetime ban. To me sounds like a lifetime ban into Canada. If that's the case he needs to pay 400??? I think and write a letter as to why he wants to return to Canada. I didn't have to go through this but I know that Chickie72 did. I will message her and find out for you.

I might be wrong as well.... So don't fret!!!

Try to google the form or order and see if anything comes up. You can also call CIC and they will be able to tell you what it's for. ***update*** I googled it and it's the repayment of the cost of the ticket that the govnt paid for him to leave.

The email address u quoted is from cic Kingston, that is address they use to send emails to applicants. It seems like ur husband was deported and has outstanding fee to be paid before he can return, if u don't pay ur application will be refused. Even if he lady voluntarily after receiving a removal letter he was still deported in their books. What exactly was ur husbands situation?

35.2. Repayment of removal costs for exclusion orders and the requirement of Authorization to
Return to Canada

Persons who were removed under an exclusion order at the CBSA's expense and are returning
prior to the allowed period of time as prescribed in R225(1) or R225(3) must first obtain an
Authorization to Return to Canada [IMM 1203B] from an officer in accordance with A52(1) (see IR
5 for the applicable cost-recovery fee). Second, they must repay the prescribed costs of their
removal as per R243(a) or R243(b).

35.3. Repayment of removal costs for exclusion orders that no longer require Authorization to
Return to Canada
Persons who were removed under an exclusion order at the CBSA's expense and are returning
to Canada after the expiry of the prescribed period of time under R225(1) or (3) do not require the
Authorization to Return to Canada [IMM 1203B] but must repay the prescribed costs of their
removal pursuant to R243(a) or R243(b).

Thank you for your reply and for helping me out, Sammy!

It states on his Exclusion Order that it was a one-year ban, which we've passed completely (it's been 2 years now). I'll call CIC in the morning and ask them (my husband will call the High Commission as well).

Looks like it is 1000.00 you need to pay and you're welcome :)

My husband overstayed his visa.

I thought i would share this post I just read on another group on this forum. Interesting thought.

We all need to start somewhere, I believe this is it for me.

If anyone would like to contribute by means of signing petition(s) or representation or free legal advise, would be greatly appreciated. I do not intend & will never ask for monetary contributions or contributions of materialistic value(s); so please be aware of any crooks who may try take undue advantage.

At last I wish all the best to fellow applicants who have already received or in the process of receiving their visas.
Right now I don't see much difference in government systems between Canada & alleged 3rd World countries with the exception of use of English, French & possibly spitting tobacco chew on the walls.

Remember it's easy to shut the door on our problems if we manage to find an easier solution but truly does the problems go away!

Good night everyone! Last night my husband and his daughter landed in Toronto! I met him in Toronto so we could fly home together. He got through immigration and customs quickly and easily. I was so excited waiting for him to pass through those doors. When he did come through we hugged each other so tight. We stayed in a hotel last night as we had an early flight out this morning to take us home. I didn't sleep at all. I was too busy watching him, afraid that if I went to sleep I'd wake up and realize it was all a dream. We arrived home at 10:30 this morning and were met by family and friends at the airport to give a big Canadian welcome! As I write this he is fast asleep laying next to me. What a fantastic feeling having him home. I'm very blessed.
To all of you that are still waiting the end result is so worth the wait!

NO PROBLEM MON! You are in good company! Also it is good that you are starting now. If you get it all done before you get married then all you have to do is fill out the couple questions about your wedding add the wedding pics and send it off right away. I tried starting before hand but it was like pulling teeth to get hubby to do his forms and properly. haha. Took me 3 months to get all of our stuff together and mailed to him to sign and mailed back. (ANOTHER reason to get it done before you go back. Not having to pay big money to mail it to him for his signature and then having him mail it back to you. ::) )
