Hi I'm new here and would love some advice as I can't find anything on google and don't know where to even start.

I currently hold a senior tech position at an IT company which I do from home full time. My company has agreed to let me keep my job if I move to Canada but I 'm not sure what the process is. I want to be fully resisted and pay Canadian tax.

My question is; which visa should I apply for and how should I move my position over to Canada, do I need to get my company to complete an LMIA and sponsor my work visa? I just need a starting point as so far the immigration advice sites don't have any info on this specific scenario.

Thanks in Advance
Patryk
(i am a full UK citizen)

If your company isn't Canadian or has no operations in Canada, you can't get an LMIA for the job and you technically don't need one. However, you need some kind of permission to live in Canada.

Thanks for that. My Fiance who I'm moving with will have a proper Canadian Job which would allow us to rent a house and get all the utilities. Is there anything else I should consider such as applying for permanent residence a while after I get there?

You still need permission to live in Canada. You can't just come over as a visitor with the intention to live there.

If your fiance holds a NOC A, B or 0 skill level role, you would qualify for an open work permit. Also - you would either need to be married or have lived together for at least one year continuously to be classified as common law.

OK, Awesome. She is an Electrical Design Engineer so She does hold a NOC A job I believe. we lived together for several years. So I could simply apply for an open work permit and then move there with her. However, wouldn't that permit be revoked if I kept working my UK job and didn't get a canadian Job earning Canadian income and paying tax?

Yes - you can apply for an OWP. No - the OWP won't be revoked because you are working remotely for a company in the UK. You are fine to do this. Note that you will in fact have to file and pay income taxes on this income. As a resident of Canada, you will be required to file taxes on your worldwide income.

You can't just "apply" for permanent residence simply because you are in Canada. You need to qualify as an economic immigrant or another pathway.

Assume your fiancee is British as well. If she's moving to Canada on a work permit, she may qualify to apply for PR after a year and can include you in her application.

Would encourage you to get a tax accountant that is familiar with doing taxes for UK citizens with income in the UK living in Canada. You should be applying for an OWP so you can work when you arrive.
