I have just checked my ecas and found that my status changed from "Received" to "In Process" :eek:
hope it will go well... so sick after 8 months of waiting and this finally starts.

I submitted my application under CEC category on June 11, 2012 and got AOR in Nov. After almost 9 months, CIC emailed me yesterday about refusal of application.

It states: You have been authorized to work in Canada in as a Quality Assurance Analyst, NOC 2171, a Skill Level A occupation. You are not authorized to work as an Information systems testing technician, NOC 2283, a Skill Level B occupation.

I applied the application under NOC 2283, as it exactly matches my job duties and responsiblities. I provided the letter of reference from employer along with application. I thought duties and responsibilities should match NOC rather than just job title and Work Permit.

It seems, that initial work permit that was issued by CIC was categorized under NOC 2171. And they might be matching the same with what is defined in application. However two of my colleagues applied under NOC 2283, and they got PR already (however, their WP was also issued with NOC 2171). It happened last year. Seems like my odd luck..

The duties and responsibilities are bit different between NOC 2171 and NOC 2283. And hence i believe they consider it as unauthorized work..

I need some advise from Seniors... What are my options ? I have already quitted this company and came back to India. Should I re-apply under CEC from India or within Canada with NOC 2171 and ask previous employer to issue me a service letter with duties and responsibilities that matches this code.

If I do that, won't CIC come back to me later and refuse my application again, because there will be a discrepancy in duties and responsibilities against last rejected application? Do we need to provide any letter along with the reason?

Please advise.

Hi Varun,

Sorry to hear about your rejection. Did you apply under the 1 year experience category ? Were you issued 2 WPs with different NOCs ? Also, if you can let us know the occupation title on your WP(s) ? Thanks

I've got three Work Permits all with occupation listed as "COMP ANALYSTS & CONSULTANTS". I have applied with 3+ years of experience in Canada.

I am assuming that my Job Title Sr. Quality Assurance Analyst falls under NOC 2171.

Please advise. Should I send a reply to them ?

Hi Nicole1006,

Usually some of us update the list as we go. It hasn't been done lately as there hasn't been much to update between everyone getting their AOR and receiving medicals. Once the medicals requests start coming i'm sure it'll be updated as we go.

Really sorry to hear about the CIC response. You said you had 3 years work experience in total, how much of it was under the NOC 2171? If it is atleast 1 full year you could re-apply. Immigration can see all your past applications however if you have the requirements (1 yr under NOC 2171) and put the application together again with explanation letters etc of the changes why and how, your case should be strong. Email them first and then think of re-applying.

I can ask my previous employer to probably issue an experience letter with roles/ duties specified in NOC 2171. But I am worried about what reason should be stated for change in NOC Code while re-apply. They could get doubtful about it.
As you mentioned, it's a good idea to mail them and see if they suggest the same.

Ok, to clarify:

1) you were on a closed work permit which had a specific noc code
2) you applied for cec using a different noc code
3) cec rejected your application

Now, to reapply using the initial noc code found on your work permit will not be an issue. Simply provide an explanation letter saying you got confused and put down the wrong noc.

However, your duties outlined by your employer cannot suddenly change. If the duties are not at all similar to the initial noc duties, you have a problem and are likely to be rejected again. However, if they are similar their I'd a chance you will be fine.

Thanks for providing the details. I would advise you to ask them if you can reapply under NOC 2171 but the question is whether your experience letter will suffice in lieu of the reference letter when employed. Even if you get an experience letter with duties under NOC 2171, this would not match with that under NOC 2283 that you submitted and the IO would be aware of the change. So you can provide an explanation letter stating that you made a mistake and have reapplied with the correct NOC code.
