Hi,

I have applied under FSW, Category 1122. My application has been reached at CIC on 25th of July, 2011.

After 6 week of my application has been reached, I have inquired to CIC regarding the status of application. Below is the conversation.

I am confused with answer of CIO. Is it a positive sign ?

Seniors please help me to analyze the answer from CIO.

hello everybody

I applied under FSW NOC7216 in July 18
my documents was received by CIO on 18 of July and i have received NER on 14th of Oct

"You have indicated that you have work experience in an occupation with the following NOC (National Occupational Classification) code: 7216 – Contractors and Supervisors, Mechanic Trades. Although this NOC code corresponds to the occupations specified in the Instructions identified by the Minister, you have not provided sufficient evidence that you performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of the occupation as set out in the occupational description of the NOC, including all of the essential duties"

Could you please advice, am I send completed forms with new reference letter shown more suitable duties and shown UCI number which was in the letter? or it won't work.
Us i understood they wil not send my documents back. do i need to pass IELTS again and send them full package or they will refuse them because they already did it one time?

"Any requests made on the basis of humanitarian and compassionate grounds accompanying a Federal Skilled Worker application cannot be processed unless the application is otherwise eligible for processing under the Ministerial Instructions.

Any requests for positive substituted evaluation accompanying a Federal Skilled Worker application cannot be processed unless the application has met the minimum requirements outlined under Regulation "



does it mean that i will not be able apply under FSW program? please advise

hello yankee and I am so sorry to hear that abou your case
I heard before many people who got NER they reapplied again with more evidences about their duties and they got PER

I am the same NOC 7216 as you and after reading your post I feel worried a bit
so could you please tell me what duties you have written exactly if you don't mind

My ecase status is showing IN PROCESS with "We received your application for permanent residence on July 13, 2011.

In my opinion I think if you send them a clarification letter and explain them with more strong evidences may you will succeed to change your NER to PER
anyway you will never lose to try
