dear all
i was going through the JUNE 2011 thread n there i came across a recent case where VO rejected a PER given by CIO. this is very confusing n i have asked a few questions there. i wud appreciate if someone here can give their opinion as to wht might have gone wrong. i am sorry if this will b apprehensive to many of the applicant who have already got PER but i guess it will help if someone can shed some light on this.
my post to the applicant was as follows:

i am really sorry to hear about rejection of ur application at the VO stage. i am not only sorry but afraid as well. i was under the impression tht in MI2 and MI3 the CIO determination of eligibility is final and VO can not override it unless there is some misrepresentation and fraud.
what i really want to ask u is:
1. u must have done ur own assessment and given points to each category accordingly i.e age, language, work experience etc. now tht u have the case specific enquiry result with u where did u scored fewer points. like was it in age or job etc?
2. do u think tht there is a recourse and u cud deal with this if ur points were unfairly deducted. i have heard cases where NER has been turned into PER. ur case was in a much advanced stage. wudnt it b right for u to contest this decision if as per ur assessment ur points were enuff. mayb more documentary proof will help if it was points deduction in education, work experience or adaptibility. as ielts and age points are pretty straightforward.
3. in case the VO is right n the CIO was wrong dont u think tht u shud get ur fee back. beacuse of there was no misrepresentation on ur part the fault lies squarely with CIO for giving u a PER. n u shud get ur fee back.
i know it might b painful for u know to talk about these issues but it wud help a lot of us here who have recieved theeir PER.

Please admin update the spread sheet , delete all the names of NOC 3131 after 31st August
after 31st august , neither fee has been charged nor PER receieved of NOC 3131 , So it is cleared that NOC 3131 has been caped at 31st August so after that evry pharmacist including me will receive his application back.good luck for next year. be concious for receiving your application back , if you may not receive call CIO. THANKS

Damn...... my luck. Again I got late by 1 week. Pre July also cap reached one week before my application was received at CIC. Again this time my application reached there on 21st Sept and I am short by one week. Godddddddddd.

Oh. I am so dissappointed with this news. Twice is just too much to take....I know. Infiant...next time around make sure your application reaches CIO on the first week of July. Keep everything ready to ship out. Don't wait for so long when you already have everything ready! Better luck next time!

Oh! that is sad Farrukh. Did you receive the NER? Even if so, please be optimist and get ready for the next attempt. I have faced "Cap Reached" twice and "Documents Lost" once. Although I felt dejected, I recomposed my self and made the fourth try which was successful. Wishing you a successful future.

On a serious note, other than cackle like a chicken, the doc pretty much asked me to do all those things. The interview before the HIV test was kind of invasive. Or maybe not, I am probably just not used to it. The med tech asked about sexual practices to check on risky behavior, etc. During the physical exam, there was really a lot of poking around the areas of the neck, the tummy, just below the underarms, and close to an unmentionable part of the human male anatomy. hahaha

You see? I did not make it sound gorier than it actually is. It can be quite uncomfortable. hehehe

I am just happy to be done with medicals. ;D

... but this animation you sent just gave me something else to fear.
