I can't believe they are charging without looking at the cap, since then they would have charged many others and also charge those from July that got their application back. Also when they return the application they return the fees, so they have to issue their own BD (which is more expansive then not charging at the first place).
Also as I understand from others experience, when fees are charged, one is in the CAP.
So this case makes the CIC procedure very strange and I would suggest, those who got their application back to appeal to the CIC as the CAP was not reached in July but in August as per CIC claims and this case of CC charge for application reached in August.
